For any creditor to Garnish your wages they have to take you to court and get a judgement against you. debt consolidation will not stop a Wage Garnishment. There are certian laws per state in how much of your paycheck can be garnished.

Stac, read the contract carefully before signing with any of your creditors. If the creditor fails to recover money from you, he will file a case in the court. Wage garnishment will be ordered by the judge only if he realizes that you are unable to pay the debt through any sort of arrangements done for you. It will be much better if you can handle the situation before the matter reaches the court. Talk to your creditors because they also don't want to file a case against you because of the court costs and expenses. Things will work out for you.

(payday loans, credit cards, etc.) This is your disposable income, which means after taxes and other voluntary deductions..such as 401k, insurance, IRA, profit sharing. This is federally mandated, so unless you live in the carolinas, texas, or pennsylvania(garnishment other than child support is illegal in these states) You WILL be garnished 25%. A sherriff will not serve you with papers, for most consumerd debts a copy will come to you through the mail and you'll get an additional copy from your employer.

lol..A lot of people are terrified about the sherriff! Trust me, I can promise you, your HR dept will get the writ of garnishment by mail!

hey finsfan ive been reading alot of ur posts throughout the froums. and it seems u have alot of useful informatin to give. my ? isnt exactly about wage garn because i live in pa but about writ of execution. court summons is only in my name as is debt i was just wondering what kind of stuff they will try to take if they decise to do writ of execution.. and also since debt is only mine have u heard of anything called entitys by ite entirity that my husband could file if it gets that far?i may have spelled it wrong sorry.. only asset we have is our home and its in both of our names and as of right now the debt attourney is not willing to work out anythign with me

the debt is for a cc..have not been able to pay on it for about 3 1/2 yrs. not that i didnt want to just alot of unforseen things have come up.. the amount is 4100.00.. well now up to 6500. with attourney fees and court costs..i tried to settle but would not settle for less then 4700.. not that i even have that amount..we have only my husbands income for now i am a stay at home mom of 3. i do plan on retuening to work but right now its not feasible. what id make id be paying in daycare.anyhow, we owe 26 yrs yet on a mortgage other then that we have no valuable assets other then ordinary household things oh and a van were paying on and myhusbands truck thats only in his name..i got so much legal stuff goin on yet from my daughters accident i dont know how much more i can take . i could prolly afford about a 75 pmt to them but thats a bout it

Basically, they just want their money. Have you had the court hearing yet? It's very important that you show up. You will be able to file for a hardship. You will need to come to work prepared..This means that you will need check stubs and w2s to prove that you are unable to meet their terms. No one wants to seize your stuff and sell it, trust me..It's a lot of trouble for them, and they won't make their money, it's like reposessing a car.
Please don't stress out. As long as you show up in court, things should be fine..With only one income, 3 kids, and medical expenses I believe you will qualify for a hardship reprieve.
By the way..Is the debt still with the original creditor? And...You may want to call an attorney and get his take..They will do free consultations over the phone. There may be other options in your state that I don't know about.

Hi am I correct from the post above that it is illegal to garnish wages in the Carolinas (except child support)? Does this apply to student loans? I had some unforesceen circumstances come up a couple of years ago, that made it so they started taking my student loans out of my check. I am fine with this, but I was just curious(I live in SC). The only thing I do not like about it is, I have not received a statment each month so I am not sure where I am at as far as how much more I owe. I have been paying this way for about two years.

I have 3 collection agencies calling me about 3 different cc accounts. I am unable to pay because of hardship and I am a stay at home mom. Each cc is in my name only, I had opened them before I was married. They are threatening to garnish my wages. I do not have any, but I wanted to know can they garnish my husbands wages?
I don't think they will be able to garnish your husband's wages.
I don't think they will be able to garnish your husband's wages. What they are more likely to try and do is seize your accounts once they figure out you aren't working. Don't let it get that far. Contact all of them, and send what you can...even if it's only $20. Something is always better than nothing.
Also, a good consolidation plan could help. You may want to consider talking with your husband about getting into a plan.
