has anyone ever sent this pdl a settelment letter? i sent one to them last week and still haven't heard anything back from them starting to wonder if i ever will.

You can fax them the letter everyday until they get sick of it, (not sure that they will get sick of it though) but it shows you have been contacting them. I would file a complaint against them with your state AGs office and add that to the letter, maybe that will get a response when you tell them you did that. It looks like in that post Mishele never heard from them again when she sent them her letter.

Jess,

I haven't heard back from them yet. They have never formally applied to any e-mails, faxes, or letters that I have sent them. I have overpaid them so maybe they are being quiet. They used to fax me at work but that has been months ago. I do keep a file just for them showing the attempts that I made and also that they did receive the 2nd letter that I sent them. They refused the first one. Keep everything documented in case you need it for future reference. :)

I have had no responses from Cashnet500 or USApaydayloans. I have faxed them letters since last week and no response. I sent copies of those letters to my bank as well. It stated on there that I was revoking the authorization to debit my checking account. Is that enough to stop it and if they still debit my account, what can I do then? Tomorrow is the next due date and I am worried that they can still debit the entire amount. I don't want to go online and try to extend the due date because it may look as though I am still in agreement with their terms. Any suggestions? My other 3 with Rio Resources, PaydayOK and Payday Select have all been resolved. (I am in Texas, just in case that matters!) Thanks, Melissa :D

I think if you do go online and extend it, it does look like you are in agreement. If you put a stop debit on this company with your bank, that should be good enough. But if you only put a stop debit for whatever amount they usually debit, chances are they will go in and debit for several different amounts to override this. I had to fill out papers with my bank listing each pdl to put a stop payment and paid $27 fee for each one, it is good for 6 months. But a few days later I just opened a new account with a new number to play it safe.

As for Cashnet 500, since they are the original creditor, do they legally have to abide by a Cease & Desist request to stop all telephone communication, or is the C&D only applicable to collection agencies? I thought it was only applicable to collection agencies, but read one of the posts from the link posted above, and a C&D for cashnet to stop all telephone communication was mentioned. I am considering sending them one, but wanted to get my facts straight before sending something that is useless.

Tif,
You are right. They are the originial creditor, so they don't have to abide by a C&D. If they end up sending it to a collection agency, first I would verify that the CA is licensed in your state since they tend to use their "own" internal CA's.
Then you may have some wiggle room to negotiate a settlement with the CA..sometimes it works.
Cash net500 are terrible to try and work with, be careful.
The only way to get rid of them is to enlist the help of your State's Bus. and Prof. Reg. Department in their Financial Crimes division. These people are there to help you, they work for the YOU!

I can't get them to work with me. The only payment arrangement they will agree to is for me to pay them $300 more than what I should owe them. I have informed them of the regulations in my state and get the same old, "We're in Utah, we don't have to follow your laws." I know that's crap, but they won't budge. I got a call at work yesterday from some lady who left me a voice mail saying she is willing to work with me, which I'm sure will be for me to pay the inflated amount. This account is in with my settlement plan, but I don't think Hess Kennedy has contacted any of my creditors yet, so I'm being hounded.

I think you will be hounded for awhile. I thought that with settlement companies that you have to have all of your money in the account before they start settling with your creditors. I wouldn't budge either if I were you Tiffany99, stick to your guns and tell them your in the state your in and YOU DON'T HAVE TO FOLLOW THEIR LAWS, and I guess that means they have a problem then. Eventually they will back down or your settlement company will have dealt with them hopefully soon.
