In Mississippi, a payday loan store cannot operate near a pawnshop, title pledge office, or a small loan company. Also, any payday loan store that operates in Mississippi must have a definitive United States Postal address, comply with local zoning laws, and have at least 100 square feet of space. As for the payday loan agreement forms in Mississippi, the term ???????interest??????? must be expressed as service fee. Also, the date of the agreement should be the same date of the transaction. Mississippi law prohibits any payday loan store from advertising payday loans without the need of identification. Mississippi law clearly states that no lender shall cash a check payable to a borrower unless they have provided appropriate identification. In Mississippi, if the borrower commits fraud or any criminal act against the lender, the Payday loan store must report the activities to the department and the district attorney for the judicial district in which the check was issued. No criminal prosecution can be imposed on anyone for late payments or insufficient funds. A payday loan store in Mississippi can offer their customers coupons for a later transaction, as long as their customers benefit from them financially. A borrower in Mississippi has the option of deferring their cash advance loan for up to 30 days of the transaction without paying any additional fees. After that, a fee may be applied to the total of the loan, but only a court of law awards any additional fees. The maximum amount that anyone can borrow in Mississippi is $400. The maximum amount of fees a payday loan lender can charge in the state of Mississippi is 18% of the face value of the check. No other fees can be applied. |
