Ms. SSN You will have to setup payments in order to receive something in writing. This is NOT a billing agency; you owe a debt so unless you provide dates to pay then further action will persist. Your account balances for both cases have been sent to your mailing address already. If no arrangement is set in place after today I’m afraid there will be nothing I can do to prevent further action. I've been getting something similar from them as well, and they turned my acct. over to a collection agency that is posing as an attorney's firm. Double-check the amount that they claim you owe, as my loan was $300, I repaid a $90 finance charge before defaulting in August, and now they say I owe $610.
i don't even know if i really have a PDL with them, let alone 2.

Tiffany99 and AmandaB:
I am familiar with PD6 ventures. Tiffany, what state are you in? PD6 ventures goes under many names - XpressCash, DMS Marketing and the Loan Shop to name a few. They are not licensed in Ohio and probably are not licensed if you're in another state. You both have every right to request a copy of the contract that you signed before you agree to anything. These people are very sneaky, so be on your guard. Tell them you want to know the specific company they are representing. They will try to tell you something like they represent "an affiliated company." That's not good enough. You need a specific company name. Once you have the name, you can do a google search from this page for Pollyandsay's and go to her blog. Under corporations, locate your state and you can see if it's licensed IN YOUR STATE. Regardless of what this company you're dealing with says, by law they have to go by the laws of the borrower's state.
If they are not licensed in your state, it's illegal for them to do business with you, and you would only have to pay back the principal. If you've already paid anything on the loan including interest and fees, deduct that amount from the original principal amount. You owe them only that amount, nothing more. You can send them a template letter found in Pollyandsay's blog, telling them they are operating illegally, etc. You can also file a complaint with the Attorney General's office, who already has a file on this/these company(s). Let me know if you need any help. Good luck!

Tiffany and Amanda:
Forgot to mention, once you find out who the loans are with, if they can't produce a signed contract, they probably did it over the phone, which is illegal in Ohio (which you can mention in your letter). It has to be a written contract (including e-mail).

only the amount you borrowed. If you've already paid any interest or "fees," deduct them from the principal. Say, for example, the loan was for $300,and you paid an extension fee of $90 one time. Deduct the $90 from the $300, making $210 that you would need to pay. If you paid more than one extension fee, deduct all of them from the principal. If it ends up you owe nothing or they owe you, you can tell them you want the account marked "Paid in full."

Xpress Cash/PD6 Ventures/DMS Marketing settled my account as paid in full when I filed a complaint with the OH Ag's office. I had paid them well over $600 on a $300 loan. They settled within minutes of their contact from the AG's office. They are not licensed in OH.

The AG's office and Dept. of Commerce/Division of Financial Institutions have a file on this company and their aliases, so please file a complaint, you can do this online if you go to the OH AG's website.

I'm in Indiana. Xtra Cash is the name on my bank debits, but the loan was taken out with 1000-easypayday-loan.com. When I asked for a statement of the account and further info., I got a letter telling me to make payment arrangements or the account would be passed on for legal action, and within days, I got a call at work from some lady who left me a voicemail saying it was an important legal matter. The same day I got a letter from ACA Recovery who use an attorney's name on their letterhead. I've since read that they are not affiliated with this attorney and have had complaints brought against them.
I know that in Indiana, the legal interest/finance charges for a payday loan are $15 for the first $100 and $10 for each additional $100, and the most a small loan can be fore is $500. The loan can be renewed up to 6 times, then there is a 7-day cooling off period before a new loan can be taken out. I also know that this company is not licensed in Indiana.

If they're not licensed in your state, though, I don't think you have to pay any of the interest or fees, just the principal.
Thought this could help
I too was a victim of this company and thanks to all of you I started fighting back and got this email. It came from westburyventures(at)yahoo.com and apparently this Mr Kimball is a supervisor.
Hope this helps someone else.

Ms. Smith --- We will be more than willing to consider your account paid-in-full. Some of our collectors have been poor representatives for our company. I have spent the past three months dealing with situations such as yours. I am attaching a legal release which states that we forgive your loan. This document should provide evidence in the event that we attempt collection activity in the future. The fourth paragraph, which begins "NOW, THEREFORE...", includes the forgiveness of the loan. Please fax the signed document to 1-800-757-8373 at your earliest convenience. Sincerely, John Kimball |

Guest,
I also just recently received a similar e-mail from John Kimball. Isn't it a relief to get them off your back?

I just realized that in my case, PD6 Ventures/Xpress Cash/DMS Marketing is actually the loan I have with VC Funding, and they are, as you know, part of Westbury. The tangle of names these companies hide behind amazes me.

I'm doing battle with these "fine folks" too! I'm not making much progress, but I'll get there! I'm encouraged by those of you who have met with success in dealing with these people...maybe I'll join your ranks soon as well!

I was contacted by John Kimball of LTS Management Services, another of their many names. Maybe if you contacted him and told him what company you have the loan with, he might be able to help you. He was very agreeable when settling the account with me. I'll PM you his e-mail address.

tiffany! THANK YOU! I did not realize VC Funding was also linked with Xpress Cash/DMS Mktg. Really thank you it explains so much to me because I had Xpress Cash mark me as paid in full when the AGs office contacted them and I couldn't figure out why I hadn't heard from VC Funding (not that I'm complaining). But I was put in the system for the collector's NEVER to contact me again. So now I'm guessing that this is why VC Funding hasn't called.
