Wage garnishment by Asset Acceptance LLC

My last paycheck was garnished in the amount of 773.xx on the first of the month by asset acceptance llc. I am working in swtzerland for a university in Calif. Just today I recieved the earnings withholding order. How can I find out who the originater and were the debt. is from. Don't they need to serve me papers prior to the court date so that I may represent my side of the case?


unless you make a lot of money, this was a wage assignment, not a garnishment. I'm assuming your paycheck is governed by California rules. Asset Acceptance is a payday loan company, correct? You can only be garnished 25% of your disposable earnings..after taxes and voluntary deductions..for a consumer debt. This is a federal law. A wage assignment, however, can take the entire amount of the debt at once. Unfortunately, you could've revoked this and kept it from happening, but I bet you had no notice. Yes, they are voluntary, but they are also legal, and your chances of getting your money back are very very slim.

Contact your payroll dept to find the originator of this. Your work should provide you of a copy of the paperwork as well..I'm surprised you don't have anything yet...If you have any questions or need any help, please pm me.

Something must be amiss with them..I find it ineteresting that they would use a wage assignment..In my experience, if a collection agency is on the up-and-up, they sue for a judgement. Hmmmmm...

Sailinstevo, what was the debt for? And..do you know the original amount? Someone did something backasawards here, and I'm gonna figure out what it is, trust me!
