MIL was hit by a driver who had no insurance while visiting us in MI. She was told since he had a minor child he could no have wage garnishment?

Is this right?

My Dh/I just had a judgement placed on us that if not PIF in 21 days we were told we would be garnished. We have 3 young children (6 and under) amd ,ake a whopping 26 k/yr... I tried to search ,minor and judgements all I can find is child support info--- any one know about this?


It doesn't matter if you have minors or not..For a consumer debt you can definitely be garnished. My advice with you is to either try as hard as you can to get them to make arrangements, or put them into a consolidation plan. What is this debt for? Have you been to court on this? If they do make good on their threat you will either be civilly sued or you will receive a notice of judgement by US mail. You DO NOT have to be formally sued in court to be garnished, the creditor can pay a few hundred bucks to obtain a judgement. Once your payroll dept receives the writ, they will give you a copy..You have at least one pay period to attempt to appeal. If you do end up being served with a garnishment, you can go to your county court and file a hardship..Bring with you w2s and check stubs, you can possibly get this reduced.

As for the car accident..That must have been the rules of that particular person..That would've been a SOM debt, and would automatically be in an attorney's hands.

consumer debt ????

I am unsure of what the debt type would be called. WE had a judgement to buy our old home a new well (2k) After the inspections and what not we sold the home and the well failed. We were in court not too long agoand the judge ruled for us to pay for it.

Is their a special form for hardship?
