I will need your guys help on a response to these idiots. I love how they say they have a recording but yet none of us have ever obtained a copy let alone when requested they deny it now they are using that as their defense. Your thoughts?

Thank you for your e-mail. Having reviewed your file, we must decline your request for re-imbursement. We have listened to the recording of the entire call of April 4, 2006 during which you accepted the loan. At no point did you mention any concerns - in fact you made verbal agreements to all the separate terms and conditions as they were read to you.

The agreed terms and conditions were very clear in relation to fee amounts, due dates and the options you would have on those due dates. You also accepted, during the call, that the loan would be covered 'solely by the Laws of the United Kingdom'. If at any time you were unhappy with, or disagreed with, the terms of the loan, you had the option to cancel the application, yet you did not do so.

If you felt that this loan may possibly breach your local laws, you could have cancelled the application. You chose not to do so and completed the application and accepted the loan. We absolutely refute the claims in your emails concerning the lack of validity of this loan.

Additionally we are obliged to inform you of the following detail. If a loan is taken with no intention of repaying in full as per the terms and conditions agreed between the lender and the client, there are provisions in UK Law for potential charges of Fraud and Deception, and these can carry serious penalties. In particular it was made clear, and you accepted, your obligations in relation to payments being taken from your bank account.

We have administered the loan account you have with us in accordance with the terms and conditions to which you agreed and would ask that you contact us on 1-877-564-7738 so that we may resolve this matter in an amicable manner.

Well, you are in the US, and UK Law cannot be carried out in a situation such as this because Route 66 entered into a financial transaction with a US citizen/resident. Their law cannot be enforced. Also, having lived in the UK for almost 6 years, I know they are breaking UK laws as well. You have not committed fraud or deception by defaulting on a loan. Millions of people have problems with paying loans back, that doesn't mean they're trying to defraud someone, does it?

Also, the fact that they use a recorded phone conversation to enter into a loan agreement is not legal in the US or UK. You were not provided with a loan note disclosure showing the apr, finance charge, etc. Even these scummy internet payday lenders based in the US that try to enforce electronic loan agreements show a loan note disclosure, even if it is electronic.

Don't fall for Route 66's blatant intimidation and lies. Stand firm...you most likely won't get a refund, but as long as you stop paying them and get the loan marked as paid, that would be some result. Have you looked at the template letter on Polly's blog for getting Cash Today Ltd. off your back? Route 66, Cash Today, Ltd., Interim Cash Ltd., are all the same company, just going by different names.

Thank you I submitted my reply with some of your info and copied everyone imaginable. Hopefully they will mark my account paid in full and quite with their tactics. My bank was to close my checking account and failed to do so and 2 unauthorized ACH debits went through and a cease/desist letter was sent (route 66 and SGQ Processing). Now my account is overdrawn and I am fighting with the bank since it is their error. Any thoughts on how to handle this? I keep getting conflicting info from my bank and the online customer service of the bank.

Do you contacting my state congressman might help to see what help their offices might offer? I filed complaints with the following places:

Tell Route 66 that you are a US citizen and to please come and extradite you to file UK charges as you have never travelled overseas and would welcome the opportunity I'm going to post the link from Route66 staff person who posted earlier today, he says he is going to visit this forum frequently and post repsonses to our questions. Don't fold, stand up to them.

Let's get some base here. Mamasita21, tell us, when the phone call was done before taking the loan from RT 66 Funding, did the company mention their laws of UK will be followed and did you agree to it?

The loan was taken 4/4/06 and do not recall any UK laws being mentioned let alone them stating they were in the UK. I recall having ask them to keep repeating themselves cause I could barely understand him. I have paid $948 to date on a $200 loan and know they are not licensed in the States and when I asked for a copy of the contract they refuse to provide me anything. I had called back after the amount was deposited and they stated they were a paperless company and they have a verbal binding contract. I have asked several times for a copy of the verbal binding contract before I found this website and people encountering the same problems, they would not even give me a legitamite email. When I had asked for an email address they told me to use cash2day4u.com, I told them that is a website not an email correpondence address. I just ended up fiding their address through this site and replying to their lovely payment reminders. I asked for a copy of this tape recording but they stated they could not provide that they were a paperless company....wtf??? I told them any type of contract both parties are to have copies of the agreement in question they continue to dispute that and the money I have paid to them thus far. After learning the laws concerning pay day loans Route 66 Funding is in violation of a lot of laws here in the States. I filed a fraud affidavit with the bank and currently working on other government avenues to get this under control and marked paid in full, aside from that my ultimate goal is get them shut down for their illegal business practices.

Mamasita21, a small thought but it will help you in the future. You became pro-active on the company only after you realized many of their violations. You researched with your state about the payday loan laws and got some legal reasons to dispute with the company. It's a good experience for you to learn about such shady companies. You will not fall into the wrong hands in the future. Use this as a learning experience and research on the companies by being pro-active in the future.
