A few months ago i ran into hard times and took out payday loans...i have almost 12 of these and I finally had to make an appointment with a BK attorney for Ch. 7.... i stopped paying on these loans a month ago...and now they call me daily a t work and on my cell. Got a call today from Geneva Roth saying i had a formal complaint filed against me. My question is...as soon as i pay my retainer for my atorney can this keep them from calling me? And how soon after you stop paying these loans can they file charges against you and attach wage garnishments...is the wage garnishment 25 % for each loan or will they do a max of 25%of my check even if i have 12 of these loans.


Are they internet or store front lenders?

Only one garnishment is allowed at a time..The rule is first in first right. However, a bankruptcy supercedes any judgements except child support. Once filing, no other deduction can be made. Only with child support are two garnishments allowed. Once you have filed, they are not allowed to contact you, but you should contact them and let them know what you are going to do.

If they are internet loans, they can't obtain a judgement to garnish unless they are licensed in your state. If they are store front, they generally operate within the law, and can take you to court. No one will press any charges agianst you.

I have a total of 11 internet loans ( i know im an idiot) and 2 storefron in my state.
How do i find out if their licensed in my state... i am in Indiana....and these are my loans through internet:

The internet loans want to send a wage assignment to your employer. They call it a garnishment to scare you.

If you registered with this site, you would be able to use the pm option. I could help you out with this situation. You are not an idiot..Trust me, most of us on this board have been right where you are.

Some of these places when i applied said that i would have to operate by the maws in wisconsin and such and accept the terms under that law.... but then i get the call today from Geneva Roth saying i had a complaint filed against me and it just scares me...i have a 13 month old and im pregnanct again and i cant deal with this stress and the turmoil its putting on my marriage

none of my payday laon companies are licensed under small loans...so what does this mean for me?

You only have to pay back the principal and the legal amount of interest allowed by your state? How long have you been paying on them. Here's an example: I borrowed $300, I paid a total of $875 in "roll over fees", my state only allows an interest rate charge of $15/$100 borrowed, so for $300 the legal limit is a total of $345 to payback. I have over paid by $530. You need to use the pdl settlement template letters on this site, insert your state laws in them and demand that they mark your account paid in full, ask for a refund if you've overpaid while your at it, (may get on, may not get one, worth a try).Also, very important, file a complaint with your state AG's office, and add that at the end of the letter. Many of us have had success with getting accounts marked paid in full with these illegal internet pdls.

I'm having a problem understanding what is allowed in regards to pdl lenders for the state of Illinois. Somebody was nice enough to send me the law but I can't understand it.I have 6 internet pay day loans all origionally for $300 ea. Would anybody be able to tell me what the maximum is that I have to pay back? Also, I can't find a lin k that works that would show me if these companies are licensed in Illinois.

On a $300 loan they can only charge a $45 fee, so the total payback should only be $345 by Indiana law. Maximum loan is $500, No Roll Overs are permitted. Criminal action is prohibited, (meaning if you have defaulted and they are threatening you with arrest etc.., they are lying they can not do that to you) They will say you have to follow their state laws, that is another law, they have to follow the borrower's state laws regardless of what you signed in the contract, that can not be enforced. You are protected by your state laws. What are the name of the companies, I can almost guarantee you they are not licensed to loan in your state.

Thank you Steelers 1. These are the internet pdl companies that I have loans with. 2 of them, I think GFS and JD Marketing call from out of the country according to my called id. They both have thick accents. Would you happen to know if these companies are licensed in Illinois? Thanks again for all of your help.

You can contact your stat AGs office and they should be able to direct you where to find out if they can't tell you. But I'm sure ameriloan, VC Funding, and Xpress Cashe aren't that's who I had mine with. Xpress Cash was one of the first to settle me as paid in full when I filed my complaints. I'm not sure about the other three but more than likely they are unlicensed in your state. Have you defaulted on any of them? I'm curious as to what Ameriloan and VC Funding said they would do to you or if they contacted you at all.

Steelers 1, I have defaulted on most of the loans. JD Marketing called me at work and said that if I did not pay $850 by 2:30 that afternoon, they were going to send somebody to my place of work or home to criminally prosecute me even though caller id showed they were calling from a different country.They said I should get an attorney. When I tried to negotiate, they told me that if I could pay $500 from my next paycheck on the 15th and the balance 2 weeks later they would temporarily suspend any action. I had no choice, but to agree even though I know I can't do it. GFS keeps calling me at work but so far has not made any threats. ameriloan has been e-mailing me. It's a terrible situation.

The truth is they are lying to you, that is an illegal threat they use on everyone. They CAN NOT have you arrested and prosecuted they are trying to scare you out of your money, they are comitting a crime, extortion. Use the template letters on this site, you will insert your state pdl laws in , and you need to file a complaint with your state AG's office against each one of these companies and put that you did this at the end of the letter. Sign up as a member and pm me the amount you have paid on each one and I will tell you what you should actually/legally pay back (and that is if you haven't already overpaid them, then you can demand they mark your account paid in full). It is going to get better if you start to take these actions, you can get through this and see that these people are liars and make false threats. If you haven't already I would suggest blocking each company from debiting your account again or go and open a new account, which may be necessary so that you can take back control of your situation. You will be alright. Just sign up as a member and pm me so I can get you through these steps and you will start see progress soon.

I just finished dealing with one of the companies you mentioned (my agreement with them doesn't permit me to discuss the details of my agreement).

Let me just say that they accepted my settlement offer. I made the payment yesterday. The woman I spoke to told me they would be sending me an e-mail telling me that they loan was paid in full. (That will be 3 down and 4 to go.)

And you can bet, if I don't get that e-mail, I'll be following up with them.

My point is this.

Keep after it. You'll be successful with it.

I also dealt with JD Marketing and they actually gave me a refund on my overpayments. They were not licensed in my state nor were they licensed in Nevada at the time. They were one of the easiest to deal with in my opinion. They cannot threaten you with arrest, this is a common scare tactic. I would file a complaint against them in Nevada as well as your home state with the consumer protection office. Nevada is good about following up on these things as I filed another complaint against a different company that operated there. As Rick stated, this will work out but you need to keep up on it. Don't let them frighten you.

Can the pdl companies call you and harrass you at work. If they send a letter to your job attempting to garnish your wages, what should you do. Do they just do this ti scare you.

Are these storefront or online lenders? You can revoke the wage assignments by sending them a wage revocation letter certified mail with return receipt and give your employer a copy. Online lenders are good at trying to enforce a wage assignment. If they are storefront lenders, they can get a court order to garnish. Pdl companies love to call and harass people. You can request they not call you at work, then send them a letter also stating to not call your job.
