My daughters bill collecters are calling my home,I tell them she doesn't live here and I don't know where she is they keep calling and tell me that I do know where she is and if I don't tell them I will go to court and be made to pay her bill. The truth is I don't know where she is ,she calls me with a calling card from time to time and lets me know she is doing fine, she is 25 adult woman and she left for a lot of reasons that had to do with her soon to be ex he put a lot no a ton of debt on her and left she could not handle it so she took to the road she gets under the table jobs and she says she is allright, but I still don't know where she is and they are threating to take me to court so what do I do know?

I have wrote across the envolope return to sender, does not live here. They still call and send letters and know I guess they will be sending a sheriff out to my door with a sumons to show up in court. What do I do if that happens do I go to court in her behalf she is not here so what do I do?

I would not go to court on her behalf, this is her responsiblity. You may somehow get railroaded. Send them a cease and desist letter, emphasizing she doesn't live there. Then they will have to stop calling. She will just have to get a judgement by default against her. You didn't co-sign for anything for her did you? Because if you did then they could come after you for the payment and sue you, if not, it's her debt not hers. They are probably bugging you because it's your daughter and figure they can squeeze the money out of you to protect her.

I think the key os wheter your signature in on the paperwork. If you signed, then I would assume you have some responsibility. But if she was old enough to obtain the credit, just being her parent does not make you liable to repay her debt.

Remember - debt collectors will lie to the ends of the earth. They will threaten with every means they can use - all they care about is getting their hands on the green bills.

Contact your daughter. Let her know who is calling and remind her they if she has a legitimate debt with them, she needs to work out a payment arrangement to fulfill it. And then send them that C&D so they can no longer contact them.

posted this message earlier but have not seen anything post -My name is not down on any loan or bill of my daughters I am not a co signer on her loans. As far as contacting her ,I do not know where she lives, she goes from state to state working under the table and by the time she calls me she is on the road again.I guess I will have to tell the courts and the creditors good luck finding her.

Yup..don't worry one iota about this...you CAN not be taken to court or arrested.
As a matter of fact, I would report them to the FTC for violating all sorts of harrassment laws and privacy issues...and sue them on top of that!!!
Next time they call, slap 'em with the FDCPA information and they'll quit! These are the ONLY people they are allowed to contact:
Quote:

in connection with the collection of any debt, with any person other than a consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector.
