I need help finding National Payday.
They say they are out of Costa Rica and that US AZ laws dont apply to them anyone know a adress for them?

This is one of those pain in the butt payday lenders that purposely make things as convoluted as possible so they can try to get around laws that regulate pdls. This is the notice posted for National Payday:
"This service does not constitute an offer or solicitation for short-term loans in all states. This service may or may not be available in your particular state. The states this site services may change from time to time without notice. All aspects and transactions on this site will be deemed to have taken place in our office in Costa Rica, regardless of where you may be viewing or accessing this site. Borrower is responsible for complying with any local statutory obligations that may exist in their state or area with respect to any transactions with Nationalpayday.com"
The contradict themselves in their own 1 paragraph statement. They say that all transactions will be deemed to have taken place in their Costa Rica office, but before that they say that "this service may not be available in all US states" (talking about the actual loan service).

Then they say that the borrower is responsible for complying with the laws set forth by their own state- but the law in this sense is a two-prong object: for you to comply with your states laws in regard to your transaction with National Payday, they must abide by your state's laws as well. National Payday is not licensed to lend in AZ, and they even say that the service is not available in all states, yet they lent money to you anyway.

This happened to me several months ago with a different lender who was out of Costa Rica. I closed my checking account so they couldn't debit anymore money from me when I signed up with T & C. They said the same thing on their website about laws in your state. When I got called from the collector, they said this was false. This call upset me because he was a real jerk and it was my first call during the pdl process. I filed a complaint with them with my AG's office after several attempts for them to clear my debt. Everything was finally settled through the AG's office though. I thought that was good and couldn't come back on me in the future. I found they had different collectors working from their homes in the US and had a payment address in the US. It was a nightmare but they wrote off my balance. Now they solicit me for new loans, fat chance.!

So I got a email from Melissa the operation Manager and this was her response:

Quote:

Your email has been brought to my attention by our Support department, thank you for contacting us. I have read your emails and carefullyreviewed your account. Please note that, in addition to our contract (Check Advance Agreement)our site discusses the apr in our APR Disclosure section, as well as theFAQ section. Remember, the first loan is free only if paid in full on thefirst due date. After that, the loan cost is 25% of what is borrowed. Each time a partial payment is made, the 25% fee is added to the remainingbalance. Our fees are no secret. While we understand and appreciate your comments and concern, please beaware that NationalPayday.com did nothing wrong when lending you funds aswe are not an Arizona-based lender. All aspects and transactions withNationalPayday.com are deemed to have taken place in our office in CostaRica, regardless of where you may be. Since the payment in full was processed to post on your last due date,Friday, 10/6/06 and it has not been returned as unsuccessful, your loan isconsidered to be paid in full with a balance of zero. We have noted your account that you are no longer employed at the place ofbusiness on file, and we have also documented your account so as to notcontact you via telephone at home or work either through live or automatedcalls.
Thank you,
Melissa

NationalPayday.com

AHH so she acknowledge that they received my email and still withdrew funds from my account? Geez these people are stupid thanks for admitting to taking money out of my account after I revoked your right to do it. And 25% APR has she not even read their website? So I filed a complaint with
AZ AG office, http://www.econsumer.gov/, and the Utah BBB
And isnt it funny that they have settled one complaint with the Utah BBB I thought they were out of Costa Rica and didnt have to follow anyone's rules.
