Hello Everyone.

National Financial Systems, Inc. has called and sent me one letter regarding a cc debt I have that is almost $6000. I called and tried to work out payment arrangements, but they wanted 1/2 upfront before they would do monthly payments. I told them I could do at least $150-200 per month, but didn't have any large amounts to put as a down payment. They rejected my offer and said that any payments I would send in would not affect my current balance and basically have no affect at all on my account.

I asked them to stop calling, but continue to send letters. They keep calling. Now, somehow, they are calling my parents house. I haven't lived there for 5 years! My mom called them back and told them I didn't live there and to stop calling. I tried to call them about 7 or 8 times, but either the phone kept ringing or someone actually hung up on me! Then I wrote a letter (which I mailed and faxed) telling them I was aware of the debt and that I did not wish to receive any more phone calls, although letters were acceptable.

After all of the above, here's my question (s). Do they have to stop calling me after I have informed them in writing? Also, they keep calling my parents - should my parents send a letter?

I see on the BBB site they are not satisfactory to work with...has anyone worked with them who can offer any tips?

I really want to pay this debt off as it is the biggest black mark on my credit.

Jen, I understand your situation but since you have the loan from NFS, unfortunately they will act stronger on you because your payment arrangements are not suitable to them. Your parents can send a cease and desist letter but they are not bound to follow it legally, unless they want to honor their request. I think you should keep yourself present in front of the company and answer their questions. This way, they won't feel the need to call your parents. Can you borrow from someone close to you for making the down payment to the company? This will be a valuable help indeed.

Actually this is a debt that was referred to them - it's not a loan. I have tried to work with them, but they refuse. I cannot borrow any money from anyone...everyone has their own stuff, no need to worry about mine. ;)Anyway, I have told them I am working on the down payment and will work with them once I have a substantial amount to give them. I guess I will just deal with the calls until then.

They are harrassing me, and I am not even the person they are looking for!!! They have the wrong number! Like you, I have tried several times to contact them during their "business hours" and they are either CLOSED or they hang up on me, and also the phone will keep ringing. I have had the same luck as you have had corresponding with this company. I hope it works out for you, though, and good luck!

I would need more info before I can reasonably comment on your topic. We need to find out which laws this would fall under(collector,original creditor,assigned debt or purchased debt,date of last payment,your home state for reviewing state laws). I will never claim to be a lawyer,but with more info I may be able to point you in the correct direction.

I too am being harrassed by this collection agency--I have filed a complaint with the Federal Trade Commission Consumer Response Center 600 Pennsylvania Avenue NW Washington, DC 20580, and I am not sure which state you are in, but I am a resident in the State of Arizona and have filed a complaint with the Arizona Department of Financial Institutions-Consumer Affairs 2910 N. 44th Street, Suite 310 Phoenix, AZ 85018. I have sent them a copy of my dispute letter and all support documentation evidencing attempts to settle this debt and cease further communication with NSFI, except for them to contact me with any specific action they intend to take--I strongly recommend you send any correspondence Certified Mail-Return Receipt Request so you have proof that each agency/entity has indeed received your correspondence. I have received my return receipt request and have communicated with the Arizona Banking Institution and was told by them, as well as the FTC that they should not be contacting me any longer. However they do continue to repeatedly or continously call me both at work and at home. In December 1999 there was a Settlement Agreement between NFSI and the FTC to pay $20,000 Civil Penalty for violating the Fair Debt Collection Practices Act. In the State of Arizona the Law and Administration Code which regulates collection agencies licensed/registered in the State of Arizona to collect debts basically piggy backs the fdcpa, so I do think that they continue to violate the FDCPA as well as violating Arizona Law. I was provided with the name of the owner(s) of this entity and they are as follows: George Kennedy,VP and Robert Hernandez, President. My recommendation is to send them correspondence (and fax them too) and then use the ripple effect, by cc'ing those collection agents who continue to harass you (which if attempts are anything like when they contact me I recieve calls from multiple agents from NSFI), as well as sending copies of everything to the FTC and the Consumer Affairs division in your state (if you don't know who that is just google consumer affairs + your state, whichever it is and you should get some good hits). The important thing to remember is to keep copies of everything you compile and to send any correspondence by Certified Mail-Return Reciept Request just in case you have to settle in court.

Regarding above entry--some more general info- Robert Hernandez-801 Harbour Isles Court, North Palm Beach Fl 33410 and George Kennedy 6 Cedarfiel Terrace, St. James NY 11780--This entity is domiciled in New York and I recommend you register a complaint with the BBB of New York as well-- BBB of Metro NY, 399 Conklin Street, New York, NY 11735, 212-533-6200 long on to the BBB website for additional phone numbers for this company and Additional Business Names, and to see what types of complaints were filed against them. Unfortunately, I am unable to post the link to this site.
