pay day loan threats and debt - help!
Date: Wed, 10/18/2006 - 06:00
I got a call from United Quick Cash Loans this morning at work. I was on another call and I hung up from my work call and accidently hung up on that line that the lady from United Quick Cash was calling on. I then got a voicemail from her and it said exactly:
"This is Miss Fletcher from CashNet. You just hung up on me but that's okay because we are going to go ahead and proceed against you, how do you like that?"
I am really scared....I don't know what to do anymore. I have 7 outstanding pay day loans (all of which I have paid something against). They are all online pay day loans. I do not have the money to pay them, as I am trying to catch up on bills I have at home (car, phone, utilities, rent).
I was told by the Steelers1 that Cashnet is liscenced in my state (ohio) and that they have had cashnet and they do not do rollovers, but I have paid them four payments of $105 towards a loan of $350.
I am scared because they are calling my house all day long and now they are calling my work (which I am not allowed to receive personal calls at work, I could get fired!)
The threatening phone call really has upset me and now I'm not sure where to go or what to do! I have tried to do debt consolidation but no one will help me with the payday loans. I am considering bankruptcy because I do not know what to do anymore.
Here is what I have paid so far:
ameriloan - loan for $200 - have paid four payments of $60
United Cash Loans - loan for $300 - have paid four payments of $90
SJM Marketing - loan for $200 - have paid four payments of $60
Route 66 - loan for $200 - have paid four payments of $79
CashNet - loan for $350 - have paid four payments of $105
Xtra Cash - loan for $200 - have paid three payments of $60
ICS - loan for $200 - have paid two payments of $89
Can any one direct me to a debt consolidation agency that can help me with these? Does anyone have contact numbers for these companies? I am scared to answer my phone anymore and now its not just at home but at work.......
Help?

Heather,
Don't let them intimidate you. They will issue threats to get what they want. From what I have figured from the amounts you have paid, you have overpaid ameriloan, United Cash Loans, SJM Marketing, Route 66, and Cash Net. You have paid back the principal. There is a templete letter to send to the companies you have overpaid to have your accounts marked paid in full. Ameriloan and United Cash Loans are sister companies to Rio Resources.
Here is the link to the templete letter.

I am battling the same situation now. I have two outstanding loans that have defaulted as of yesterday with licensed pdl lenders that I had obtained on line (Check 'n Go and CashNet USA). I sent them letters two weeks ago and almost everyday thereafter stating my situation and what I could afford and currently waiting on their newest reply.
As far as CashNet was it CashNet 500 that you have a default loan with? If so, they are not licensed in OH. I am located in OH and had a loan with them that they zero out for me. After finding this site and the helpful people I would still be battling 12 pdls. Aside from the two licensed lenders that are in default, I managed to work out payment arrangements with four of them. Its a start but the cease/desist letters that are often referred to on this board by members and from Polly's blog are a God send.
As Tammy stated you have overpaid on your loans. Let me know if the CashNet you are referring to is the same as I had if so, I can give you the contact information and who I worked with in getting this account marked paid in full.

It is Cashnet 500. I am just beside myself because I don't have the money they keep demanding. The letter template confuses me a little because of all the parts where the paragraph might not apply.

You have to tailor the letter to your state laws. You have paid back the prinicipal amount borrowed. There are several of us here that will help you with the templete letter.

HFeather, The templates were created by the person whose situation applied to at the time, cut the parts out that do not apply to you and replace with language that does apply. Keep working on it, you should be able to come to agreements with them if not you can always ask for input from the forum.

If you had Cashnet, they won't do roll overs in OH. I had a loan with them and I had to pay it off on my next payday. They are licensed in OH, and when I asked if they did roll overs they told me that they won't do roll overs in OH. They actually only charge me a $8 finance fee for a $200 loan because I paid it off 4 days before it was due.

i did have a loan with cashnet500....their website is cashnet500.com...i logged in and they said i am a collections customer. i didnt pay off my loan by pay day, they just deducted the fee like all of the other ones did...they are the ones who left the threatening message this morning. i have paid $420 so far to them and I feel my account should be closed.

Steeler...
Where did u get that information from that cashnet is licensed in ohio?
I can't find it anywhere.
When I checked the ohio licensee database, it came up with The Check Giant, LLC and the business name cashnet USA...I don't think they're the same.

I do not think that CashNet USA and CashNet500 are affiliated because Cashnet500 is not abiding by Ohio laws. They have renewed my loan 3+ times. They are based out of Utah. I hope the cease and desist letter I am going to send them takes care of this.

is there a company with whom i can consolidate all of my payday
is there a company with whom i can consolidate all of my payday loans into one payment a month, or another type of repayment plan? I know I have overpaid many of these companies, but now I read things about people having lawsuits and fraud against them for not paying them back. I just simply do not have the money or resources to do it at this time.
I have contacted a few debt consolidation companies, but none want to deal with payday loans...........
I'm seriously considering bankruptcy or something of that nature.........
over payment??
I also have three of which are payday loans in wisconsin all online, I have been making my payments every two weeks but on extension of loan and my balance stays the same, but if I calculate it right, if those payments would actually go towards the loans I would of had all paid off by now, so my question is this... you are stating to hfeather that she has made overpayments have i even though they are for extensions?

I understand your freustraiton with the payday loan industry and hopefully we can hel you here. If you haven????????t already registered then go ahead and do that, someone will be in touch with you to help you sort this mess out. I myself got mixed up in the PDL industry I think sometime late last year or early this year. I was pretty good at getting them paid off but then in June I lost my job and that whole idea went kaput. So anyhow I am now working to pay these off by the year 2016 lol. My advice to you is close you bank acct and open a new one, do NOT give out your new banking infroation to anyone ever again as they will ALWAYS put their hands in your cookie jar and bleed you dry. Also if you can get your phone number changed thus the irritating collection calls will stop. This is a total pain I know but it will take the pressure off you. If you need to send them a cease and desist letter but use it with caution. I copied and pasted here the one I used and it seemed to work. There are many people here to help you so go ahead and post away but first call your bank and get that acct closed so you will have food money at the end of the week. Good Luck.

You then need to use the settlement template letter on this site and insert your state's pdl laws in it, demand in the letter that they mark your account paid in full and FILE A COMPLAINT WITH THE AGs OFFICE. Mention that fact in the letter, that you have filed a formal complaint with the AGs office. You may also want to put a stop debit on your bank account with these companies or open a new account, that is probably the only way to take back control of your finances.

Welcome Do as steelers says and file that complaint with the AG. Like Tammy said you have overpaid on some of these. I wouldnt pay them anymore. The ones that are affiliated with Rio Resources will not stop. They will threaten everything but they are blowing smoke. Especially United Cash they are not licensed anywhere. And they run from state to state. Good Luck Kyside38

hfeather, my name is Ashley, can I use your story as an example of the threatening manners in which these people try and intimidate people. I won't use your name or any personal information, just the facts and your post to the board. If you would let me know, thanks and I hope you are doing okay. I understand your pain and frustration.
