A lawyer/ really a CA- sent me a certified letter about an agreed judgement. The case is set for "trial on merits" in December. I answered the original complaint, but can't afford a lawyer for the trial.
(it is just in a JP court)

My question: what is an agreed judgement? Does that mean that I concede I owe them and we work out a payment arrangement? I think it would still go on my CR as a judgement. I am planning on fighting becasue some of the charges were disputed - but fear I will lose because they filed the suit 2 days before the 4 year SOL had expired. Advice???

Quote:

A consent judgment, or agreed judgment, is a final decision that is entered on agreement of the litigants; is examined and evaluated by the court; and, if sanctioned by the court, is ordered to be recorded as a binding judgment. Consent judgments are generally rendered in domestic relations cases after the husband and wife agree to a property and support settlement in a divorce.

i would think if its an agreed judgment it will still go on ur cr as a judgment ..its just an agreement with u and ca that u owe the debt and the amount and u more tehnlikely will set up some kind of pmt arrangements with them but be careful if u do and get everything in writing 1st to cover ur own butt..ihave a similiar situation only thing is they tried to get me to do it day of hearing before we went in to see judge..wich i did not only because the info on the account they had with them was very vague..i was basically told ifi didnt agrree to it them all deals were off..the only thing i would caution is not knowing what state ur in how far a judgment could be taken( ex:wagegarn, writ of ex,levy,ETC).. now sometimes in an agreed judgment u can most times have many fees waved and reduced but like i said before have it all in writing and read it thouroughtly 1st..for ex if ur paying voluntarly as that no garn takes place if u keep p with what u agreed or thatas long as pd on as agreed no writ of execution and such and that it will be removed as soon as its pd
