Help pleazzzzzzz, New to the boards and have 6 payday loans
Date: Sat, 10/21/2006 - 01:14
I'm new to these boards, but have been reading and reviewing posts since I startedd to have difficulties paying off payday loans. It's been a great help to see that I'm not alone...really it's giving me strength. I got into this mess because myself and my son got very sick and don't have medical insurance so we needed the money badly. I had ended up waiting so long to see the doctor that I developed bronchitis.
I've seen some great advice and have finally made the decision to sign up. Since discovering this board, I've learned quite a lot and I'm going to start the process of following some advice and experiences I've read about.
I was hoping maybe you all could offer me some additional advice that is maybe a little more specific to my situation.
I currently live in the state of Virginia, and if I'm not mistaken, payday lenders must be licensed to lend in this state.
I have loans with the following:
Nationwide Cash Advance
: $500.00 + $150.00
Web Payday
: $500.00 + $150.00
Oneclickcash
: $300.00 + $90.00
VIP Cash
: Loan for $300.00 + $60.00 - have paid them a total of $435.00
I don't think these lenders are licensed to lend in the state of Virginia.
I've been trying to pay these off, but things keep getting worse because I really didn't understand what we were getting into at the time. I tried to talk to my bank about help and they were no help at all.
I have automatic ACH's with these people, so my bank account keeps going in the negative :(
Is there a letter I can send so that I can revoke the ACH?
My contracts say that if I do that they'll just try and write checks. The contracts are have the same stuff I see all over these boards, like extremely high interest rates, I can't revoke their right to make checks on my behalf, etc... Some of these lenders have taken to harassing friends, and even co-workers by calling and calling, even after being told not to.
My bank account is with a credit union, and my dh's pay is direct deposit there, and we've been with this bank for years. We're trying to avoid having to close the account, but it's looking more like we'll have to do it.
Any adivce or examples of revoke letters for ACH?
Any other tips or advice would be soooo appreciated. :)

I have bank with a credit union also. They let me put a stop debit on my account and I listed the company name of each pdl. So it wouldn't matter if they presented a check their company is listed as a block and the check wouldn't go through. They did however eventually close my account and open a new one because of all the dbas these pdls go by and were concerned that I had not listed them all. The revokation letter is simeple Use the settlement template letter on this site, you can incorporate the revokation at the beginning of the letter (I think it is already there for you, you just need to fill in the info as it pertains to you and your bank) You will need to e-mail,fax, and mail this to each one of them. And some people do it daily to eventually get a response from them. I will post the template link for you. Another important step is to file a complaint with your AG's office and at the end of the letter let the pdl know that you have filed a formal complaint against them for operating without a license and charging illegal interest rates. I will post the template letter link for you.

Here is the template link: Please feel free to pm me if you have any questions or need additional help. You are going to be fine and will get out of this mess. Please be aware that these pdls are going to threaten you with false threats such as fraud charges, arrest, etc....Although it is truly upsetting and scary to hear somebody threaten you, and it will sound legit. Just know they can not do this to you in your state, they are unlicensed internet pdls in VA and you will not be charged with fraud or arrested.
