just a few ?s on DV letters..1st is if u do not dv within 30 day pd can u still request one after that time. and do they still have to provide one for u?...2nd is after u dv them do they have to quit callin u until they provide proper validation and if so is against fdcpa codes if they continue to call u?

There is no time limit for asking for debt validation. If the account is with a collection agency, they are bound by the fdcpa to provide you with validation. I recently heard that a new law has been passed where the collection calls can continue during the validation perid (I have not done research on the subject so I am not 100% sure that is correct). If the account is still with the original creditor, depending on your state, they do not have to validate the debt or stop calling you (most original creditors will be able to provide you with an account statement though).

thnx for the info..the reason i was asking was because i was taken to court for this debt that is no longer with oc but a jdb..its been almost a month since i sent letter and still not anything .they did bring a sheet with them to cousr hearing but everything was vague on the sheet so i didnt agree with anything on it..should i send follow up request and if still no response should i ask teh judge to dismiss it since they have already asked for 2 continuances?

Guest, if they have not validated, you can send a follow-up letter and DV. I have done this with one company for 5 months now. They pass it aroung their office, don't validate and I send them not only a follow up letter, but a copy of my request for DV that was first sent to them. The more paper work you have to show you are trying to get some answers and proof they are legally bound to collect this,the better. Keep copies of everything. Good Luck...Karen
