You could make an offer to the creditor and see if they accept it. That offer could be anything from lump sum to monthly payments or any combination. The creditor does not have to accept and still has rights to collect on the judgment.

I had a default judgment placed on me but the Plaintiff has told me that he will not file the default so it will not runi my credit as long as I make payment arrangements with him. If the judgement is never filed do I truely have to accept payment arrangments or am I free to try an fight it.

im not sure how to answer the above post, scince im not sure if they can do that or not. but i know from my experience i had a judgement against me and i had no income so they put a lein on my home. i live in a no garnish state so you may consider if your state is that way too, so if it is you can rule out that scenerio, also the judge can schedule a payment schedule according to what you can afford, but if your name or ss is not on any of those cards then you cannot be held liable for them. there are many things that can be done when you have lost a judgement. usually the judge will explain to you what these terms are before you leave and what will or could happen if you do not follow these terms

Even if people can garnish your wages and freeze your bank accounts after a judgment, surely there is a limit, right? I mean, you have to be able to pay for rent and food and stuff like that. They can't just clean you out and take everything so you lose your home, can they?

I am going thru a similar situation. In my case the lawyers do not want to work with me and do not want to accept paymet arrangments. My wife recently lost her job and we have other bills we have to pay plus 2 little kids under the age of 5 to support. I have explained this to them many times via certified letters and phone calls. They have only responded twice saying their client will only accept what they are asking for. We fell behind due to a death in my wifes immediate family last year, I had an accident and was unable to work and my wife just had a baby, she had been working part-time due to her high risk pregnancy. She went back to work for and shortly after lost her job. The lawyers have issued a citation to my employer to garnish my wages. At the last court date we came to an agreement. The lawyers agreed to a lesser amount, now they are saying the OC will not accept. What can I do? I live in Illinois and cannot afford a lawyer to appeal. What other options do I have if the lawyers will not listen to me. By the way the OC is Wells Fargo. We the taxpayers bailed them out, where is our bail out? Help!

This was a huge unethical case. I sued the state for discrimination, with the BOLI agency supporting my claim. The state used unlimited resources, threatened their employees, had a string of witnesses from the state to say what they wanted. I lost. Now with a judgement I have no funds, no job, no savings except my husbands. What can they take from me.

I recently received a letter to appear to a pre-trial hearing with a creditor on a vehicle. I gave a vehicle back. My husband lost his job. I was down to one income, 4 kids, bills, mortgage and another car I am about to pay off and could not afford anything extra. I went in we postponed the hearing for 4 weeks if we could agree to work on a payment agreement. But when I talked to the legal she said they would file a motion for 10% liability. I cant afford an attorney therefore I do not know what to do? WHat is that? What if they do not accept my proposal can they still tack on 10% on the already balance due?

I was just issued a civil judgement in the state of ohio. The first time we went to court the attorney for the plaintiff dismissed the case because he discovered the plaintiff had not filed my insurance. I received the paperwork from courts and plaintiffs attorney saying case dismissed. For some reason they decided to take me back to court for the case 3mon later. Here's what you should know:

1. State exemptions. Some assets are exempt from seizure for a judgment. You can Google your state statutes or call the clerk's office and ask for help. Legal aide also offers assistance for little or no costs.

2. Garnishments. Some states prohibit garnishment, like Texas. Again check your state laws or call the clerk's office. Even if they allow garnishment, they typically are not allowed to take more than 20 -25% of your pay. If you have a hardship, you can file documents with the court proving hardship and get the final order amend the order.

Crooked judges are trying the complaint made in Federal Court as the second complaint made in State Court. First com The rooked plaint was Racial Discrimination. Second complaint was Retaliation (Wrongful Termination). They listed the second complaint as Race (Discrimination). My evidence submitted supported a case of Retaliation. The crooked judges in the appeals court based my case on race discrimination. I was Pro Se and the judges know I won that case. They were bias and protected the appellant. What do I do next?
