im not sure how to answer the above post, scince im not sure if they can do that or not. but i know from my experience i had a judgement against me and i had no income so they put a lein on my home. i live in a no garnish state so you may consider if your state is that way too, so if it is you can rule out that scenerio, also the judge can schedule a payment schedule according to what you can afford, but if your name or ss is not on any of those cards then you cannot be held liable for them. there are many things that can be done when you have lost a judgement. usually the judge will explain to you what these terms are before you leave and what will or could happen if you do not follow these terms

My wife recently lost her job and we have other bills we have to pay plus 2 little kids under the age of 5 to support. I have explained this to them many times via certified letters and phone calls. They have only responded twice saying their client will only accept what they are asking for. The lawyers agreed to a lesser amount, now they are saying the OC will not accept. What can I do? I live in Illinois and cannot afford a lawyer to appeal. What other options do I have if the lawyers will not listen to me. By the way the OC is Wells Fargo. We the taxpayers bailed them out, where is our bail out? Help!

I was down to one income, 4 kids, bills, mortgage and another car I am about to pay off and could not afford anything extra. I went in we postponed the hearing for 4 weeks if we could agree to work on a payment agreement. But when I talked to the legal she said they would file a motion for 10% liability. Here's what you should know:
1. State exemptions. Some assets are exempt from seizure for a judgment. You can Google your state statutes or call the clerk's office and ask for help. Legal aide also offers assistance for little or no costs.
2. Garnishments. Some states prohibit garnishment, like Texas. Again check your state laws or call the clerk's office. Even if they allow garnishment, they typically are not allowed to take more than 20 -25% of your pay. If you have a hardship, you can file documents with the court proving hardship and get the final order amend the order.
3. Negotiation. Yes, even post judgment Plaintiff's will normally negotiate payment either via a payment plan or lump sum. If you stipulate, know what you're signing, OK? Doesn't hurt to talk to a paralegal or attorney for assistance.
