I know I answered a question on about giving a collection agency post dated checks and them not being able to cash them before the date assigned. I haven't forgotten about the question I just keep forgetting to bring the book home that has the rules and regulations in it!

It's getting to the end of the month/close out, and it's extremely busy at work right now.

This website states it is against the law to post a post dated check early. You have to read down a ways, it's near the bottom. I'll also try and remeber to bring home my book so that I can put exactly what it says.

Thanks FYI for your another strong and educating post.

The laws are there to protect the consumers and the fdcpa is one example educating people about their rights. How unfortunate that many of the collectors are not bothered about it and continue with their unfair and deceptive practices!!

A collector who involves in these illegal activities knows well that people don't have extra money to file a court case against them. If there was money, the debt wouldn't have been left unpaid and reaching the hands of collectors. One must know that a collector violating the laws can be sued in a state or federal court within one year from the date of the violation of the law. If you aren't able to go to a court at that time, take your time and do it sometime later. You have the proof of the violation and the court will help you in recovering money for the damages. You will also get back the court costs and attorney fees from the collection agency held guilty.
