I understand that a company cannot call an individual at home on Sundays in Ontario, Canada, regarding an outstanding debt? Is this correct?

Can someone help?


Collector, the rules are different for Canada, particularly in Ontario. Wells Fargo called my house today regarding a CC. I went on the government of Ontario website and the Consumer Protection Act forbids any collection calls on Sunday. I will be phoning Wells tomorrow to lodge a formal complaint. Also, the account was paid last monday. The gentleman caller acknowledged that payment was received and when my next payment would be. I advised that 1st he wasn't allowed to call on Sunday according to the Act and 2nd my next payment was not due until the end of November.

When dealing with Wells Fargo, be prepared to be harassed and belittled! They are the worst mortgage company around. Luckily we got our home refinanced and completely free of them. Confused, it does absolutely no good to complain about anything to them. They lose payments when you pay online and when you have a confirmation number and try to give it to them, they state their mortgage site doesn't give confirmation numbers.

My mortgage is with Wells Fargo and Tammy is right. They are the worst I have ever dealt with. I pay my bill online and they still call me. I have confirmation and they say no. It is their billpay service. Go somewhere else if you can. KYSIDE38

According to the Consumer Protection Act for the Province of Ontario, a creditor is not allowed to call the debtor on a Sunday, irregardless of whether to confirm payment, or to collect on a past due account.

They are allowed to call Monday-Saturday from 7:00 am until 9:00 pm.

Yes, WFFRS is a first party collector, but nevertheless they are calling regarding an account. They cannot do that in the Province of Ontario on a Sunday.

I called Wells fargo this morning and was told this law of calling on sunday does not apply in Ontario so I ended up appoligizing to them. I could just cry

So now I understand they can call on Sunday between the hours of 1pm to 5 pm. I believe the law should be changed because this is not right everyone needs one day of peace and quiet, when you are a senior and trying your best. I am available anytime from Monday thru Saturday. From now on I will not answer the phone on Sunday.

Okay, not talking only about Ontario here, but isn't there some kind of law regarding collection calls period? For some reason, I'm thinking there is. Like when they can call (the times/days/etc)? I swear, I thought Sunday was a "no call" day. Does the law vary from state to state? Or am I really off base here?

There is only a time frame in which calls can be made. 8am-9pm 7 days a week. I wouldn't know anything about laws in Canada other than what has been posted here. Holidays are also ok for calls to be made.

Thankfully I have those off because they don't want to give me time and a half.

Okay. I thought I knew a little something. I thought it was no calls past 9:00pm. But I honestly didn't know it included Sunday. And holidays also? I had no clue about that. Man, that would suck. I'd hate to get a collection call on Christmas morning.
