Calling on a Sunday

Confused,
I thought the same thing but, I had a phone call this morning also. Next time I speak with them, I'm going to ask is Sunday considered a business day for them. I thought business days were Mon-Fri.

the fdcpa fair debt collections practice act lets then call mon-sun 8am till 9pm

9pm at night seems kinda late in the evening to be trying to collect a debt. Do you expect someone to run out and do a money gram or western union at that time? I'm not :evil:

Collector, the rules are different for Canada, particularly in Ontario. Wells Fargo called my house today regarding a CC. I went on the government of Ontario website and the Consumer Protection Act forbids any collection calls on Sunday. I will be phoning Wells tomorrow to lodge a formal complaint. Also, the account was paid last monday. The gentleman caller acknowledged that payment was received and when my next payment would be. I advised that 1st he wasn't allowed to call on Sunday according to the Act and 2nd my next payment was not due until the end of November.

wells fargo is 1st party not a 3rd party collection agency

I don't think confused was behind, I believe if I read confused's poste correctly the bill was paid and isn't due again until November. Probably a courtesy call.

I think you are confusing creditors and collections agencies. Wells Fargo is your creditor and the rules that govern collection agencies do not apply.

When dealing with Wells Fargo, be prepared to be harassed and belittled! They are the worst mortgage company around. Luckily we got our home refinanced and completely free of them. Confused, it does absolutely no good to complain about anything to them. They lose payments when you pay online and when you have a confirmation number and try to give it to them, they state their mortgage site doesn't give confirmation numbers.

My mortgage is with Wells Fargo and Tammy is right. They are the worst I have ever dealt with. I pay my bill online and they still call me. I have confirmation and they say no. It is their billpay service. Go somewhere else if you can. KYSIDE38

According to the Consumer Protection Act for the Province of Ontario, a creditor is not allowed to call the debtor on a Sunday, irregardless of whether to confirm payment, or to collect on a past due account.

They are allowed to call Monday-Saturday from 7:00 am until 9:00 pm.

Yes, WFFRS is a first party collector, but nevertheless they are calling regarding an account. They cannot do that in the Province of Ontario on a Sunday.

I must be the only lucky one. Does Wells Fargo call a lot - yeah. But when I had some major financial issues, they were a DREAM to deal with. Getting it squared away was a breeze.

When we got into trouble with our mortgage last year, we called to try and see what our options were and they stated no options, just pay your mortgage. They are ruthless.

I called Wells fargo this morning and was told this law of calling on sunday does not apply in Ontario so I ended up appoligizing to them. I could just cry

And actually, the fdcpa does indeed allow calls on a Sunday. When I worked in mortgage collections, we had a LOT of upset people on Super Bowl Sunday.

They went into effect June 1, 2006 for the Province of Ontario. So, Lynn, what Wells Fargo told was incorrect. The only time Wells Fargo can call on a Sunday is between 1:00 and 5:00 pm. That's it.

So now I understand they can call on Sunday between the hours of 1pm to 5 pm. I believe the law should be changed because this is not right everyone needs one day of peace and quiet, when you are a senior and trying your best. I am available anytime from Monday thru Saturday. From now on I will not answer the phone on Sunday.

Lynn...I agree 100%! I know many people that simply will not answer the phone on a Sunday.

I disagree. Sometimes Sunday is the only day you can catch someone at home. I don't work Sundays unless I have to and I adoiv Saturday as much as possible but the weekends is sometimes the only time to reach people who are busy at work durring the week.

All Lynn is saying is that she wants a day of peace. I dont think this is an Agree vs. Disagree here....she solved this by not answering her phone.

I wasn't attempting to argue with anyone. Just to simply state my opinion that I disagreed with that opinion as it were.

Okay, not talking only about Ontario here, but isn't there some kind of law regarding collection calls period? For some reason, I'm thinking there is. Like when they can call (the times/days/etc)? I swear, I thought Sunday was a "no call" day. Does the law vary from state to state? Or am I really off base here?

There is only a time frame in which calls can be made. 8am-9pm 7 days a week. I wouldn't know anything about laws in Canada other than what has been posted here. Holidays are also ok for calls to be made.

Thankfully I have those off because they don't want to give me time and a half.

Really! I didn't know about the holiday calling! I never got called on a holiday, so I thought they were closed.

Okay. I thought I knew a little something. I thought it was no calls past 9:00pm. But I honestly didn't know it included Sunday. And holidays also? I had no clue about that. Man, that would suck. I'd hate to get a collection call on Christmas morning.

I get calls on Sunday. Not as many, but some. Seems kind of heartless to call on a holiday, but then again-people are home then, so why not call!

I never answer my phone when I am home. I am on the phone way to much. If I need to talk to someone I call them. Well I do answer it for the school. But that's it.

I agree FYI...I'm in customer service & on the phone for 8 hours a day-as I'm sure you are (maybe even longer some days!). I only answer at home if its my parents. Everyone else can contact me via the mail or email or leave a message. Some of the collectors don't leave a voicemail...

Lynn, just do what ever makes you comfortable. There are 7 days in the week, if you chose to ignore calls on Sunday, then do so

We're just talking about phone calls here...but I am sure it has happened.

You cannot place collections calls on a holiday. That is pretty standard across both Canada and U.S.

Would this be state collection laws that would not allow calls on holidays? I agree that it's bad form to call on a holiday, but I can't find any federal law saying it's illegal.
