wolpoff&abramson seved me papaers and still call daily?

My wife without my permission activated a cell phone account using my name for her brother who did'nt pay the bill now i owe 900.00 to wolpoff&abramson and have to go to court,yet they keep trying to call me anyway what do they want???what should i do since i feel i don't owe this debt?


I think you should have a talk with your wife and his brother about this debt. They used your name without your permission. The company knows this debt in your name so you are liable to pay it. Since it is a family affair, you all should sit together and find a solution.

Get the debt validated by wolpoff & abramson so that you are confirmed about your money going to the right place and it will be posted to the account.

The only way you are going to get out of it is to go file a police report against your wife or her brother for useing your information without your consent.

Another option is to tell the brother he has to pay the debt. Make him mow some lawns. Lawncare is a lucrative business now days.

They are going to continue to call you until the debt is paid.

im dealing with thesame company right now. just like every1 else here has said i would talk to ur wife and brother about this and let them know that they need to take care of this.. this company is on the worse list and are very hard to deal with .i have sent tehm a dv letter andas of now stilll havent gotten anythign in writing..i have already been to court for this and they had it continued 2 times..they still call me at least 3 to 4 times a day so they will not let up on it...

believe me folks this "collection law firm" are the biggest trash outfit around. please take it from me though they will garnish your wages, they got me for a JH hospital bill from 2004 in the amount of $767.00 because the insurance screwed up. I have been fighting the insurance co. for almost 2 years, another lost cause, but now with their interest they are sucking $915.00 out of my wages. i have to take a major blow now and let my payroll dept take out the balance of $620.00 this week which is my bonus week (car payment and rent) just to get rid of these pieces of s*^t. just watch yourselves guys because they will garnish your wages.

In my state, Delaware, (I thought this was federal law too) no company can garnish your wages without a judgment from court...period. They can't even threaten you with that statement if there is no judgment.

I posted that I fought afni on a cell phone bill that I did not grant permission on. First I disputed with the CB's citing fraud. Bottom line they couldn't prove it was my account as they did not have a signed contract with my signature. I have learned in a short while that these CA's want to scare you. You can't let them. You have rights and part of your rights is they can't threaten you with unfounded statements. Send out your cease and desist letter via certified mail. The second they contact you they are in direct violation of the FCRA. I would NOT tolerate this behavior from any CA. Maybe I would be called naive but after working on my credit reports for just over a month I have eliminated over $6000 worth of debt and had the agencies delete a judgment that was satisfied 3 years ago. They removed a car loan I cosigned for my daughter due to the inappropriate manner the CA handled it, and this loan still has a balance on it. I sent all the information to the original CO and showed them the
inappropriateness of the CA.

Just recently I had a CA call me...you know the statement this call may be recorded blah blah blah, well I told the CA the exact statement and pressed record on my phone. They haven't called me since.

I sent them an e-mail stating as much. now as far as garnisment, I don't think so, I am a server, I do not get a paycheck, I also have no assets (I keep it simple)I do not own a home nor do I have a checking acct, so I think they are prety much out of luck. I told them this is not my debt, go find my x and to leave me alone and if they didn't I would take my CASH and hire my own attorney. I also told them that I know that they are the dirtiest of the dirty when it comes to law firms and collection.

Do you pay taxes on your wages?

These slimeballs will report you and your employer to the IRS to get them to comply and nail you with back taxes and tax liens.

Even if the debt is SOL, writing something like that will just expose you to a greater liability.

You should minimize your exposure (cash you open up to any debt collector, even the IRS), when defending yourself against a possible suit.

thnx cajun bulldog and hockeyman, I only spoke that way here, I did not tell them they were sol, just that I was miffed at what debt they were asking for, and If it was what I thought it was it is no my debt, that is all, I personally feel that they cannot get me because I do not get a paychek, it is as tho I work for myself, when you are a server the only way to file and pay your taxes without owing is to pay quarterly, so I just do not think they have a leg to stand on and or any way to punish me, as I said, I get paper for a check but it has no dollar value, just statistics, I own only my 10 yr old paid for car, ,I rent. that is it, I pay cash for everything, including my credit cards and ins, so I think they will have to go collect from my x, just sayiin

hockeyman is correct.You are getting personal when you need to be objective in this matter. First thing that I would do is find out the sol for the debt because if it is ten years old,it is out of statute for most states,so it would be a firm defense if they attempt to sue you on this.
