Civil Summons / Judgement Response?

I've been served with a Civil Summons, in NC, for an unpaid credit card balance. Roughly 4 months prior to having received this summons, my debt settlement Co. had sent a power of attorney indicated that they are working with us to settle the debt (asap), but the account number they included in their correspondence may have been incorrect (off by 1 digit). Hence, they may not have gotten the account properly noted and forwarded it to a lawyer for judgement processing. The Debt Settlement people tell me that I now have to "respond" to the Summons (in writing), indicating that I disagree / deny "the AMOUNT due". But, I don't know where to get a Civil Summons Response Form (if one exists), or at least a proper Response from which to "benchmark" something I'd type up on my own. Any advice / direction???


You will get the form from the court that has served the summons on you. You need to visit the county clerk and verify if there are any papers filed against you by the credit card company. The clerk will give you instructions on how to go ahead. It will be good if you can hire an attorney and let him handle this matter.

The county clerks office should have these forms, just make sure when you go to court that you have the documentation that the debt is being made good just the account number was wrong, the court SHOULd be understanding but you want as much ammunition as you can get when dealing with the court system
