CA dispute

okay so I sent in a dispute letter to the CA asking for proof of a debt. It's my wife's account and I know it's valid, however the CC she had 4 years ago was cut up and sent back with only 400 in charges. they letter from the CA was for around 5500. So we sent in the letter and all they sent back was a statement from the CA showing that the CC had a princp of 4000 and interest of 1500.

What are they required to send as proof. I'm guessing an invoice from the CA isn't proof. Also how could a CC with a 500 limit show 4000 in charges and 1500 in interest?

What's the next step?

Oh and yes I'd like to pay this off...I don't like my wife being in debt...however there is no way in hell there are $4000 in charges on a card with a $500 limit...I understand the interest because I know that most CC companies will stick you with unheard of interest if you get so much as 5 seconds late.

A debt validation will cover the following points when you request the CA for the information. Go through the FTC website for knowing this portion.

The account is delinquent since the last four years. The charges may have added over the period of time. Do you have the contract signed with the original creditor that will explain these charges? You can also call the original company and make direct payments to them.

Welcome to the forums. I would register and have a debt counselor contact you. They could give you some good advice on how to settle this matter and maybe get some payments low enough to pay it off. Good Luck KYSIDE38

The info that is given out doesn't cover the debt validation in anyway. When you ask for debt validation from any collection agency, following information is to be put in writing. Refer them the FDCPA laws, so that you get more info about this account and review it carefully. You need to dispute them before the 30 days timeframe otherwise they will assume that you have agreed to what they have given out. Send your letters through certified mail for records and keep copies in your important folder.

Asset Acceptance sent me the same thing. A print out with my name, address, and false phone number, and a balance with fees. That's all they will send. I have asked them for debt validation and never get it.

It has been a year and the debt hasn't been validated. The credit agencies tell me that Asset verified the debt was mine, but they don't tell how it was verified or validated.
