What to do about Asset Accep Corp

I received a summons that was filed with my local municipal court through Asset Acceptance Corporation. The plaintiff is SBC and it is for a telephone number I had 4 years ago. What steps do I need to take to get this taken care of. The amount is 2500 and I cannont afford to pay that right now. They are really hard to deal with when it comes to making payments. It says I have 28 days to file a reply, then three days to do something else. Not sure what it is. If I contact them will they negotiate to keep it out of court? If it goes to court, can they garnish my wages? I will lose my job if that happens. Also, what if I offer them a settlement? Any help would be greatly appreciated. Thanks


Your employer is prohibited by law from taking any negative actions against you. He can't fire you from your job because of the wage garnishment. But your employer might form a negative opinion against you abstaining from promotions and raises later on.

Definitely check the SOL in your state. The collector can attempt collections anytime but if you know the debt is out of the statutes in your state, you get the legal protection from them. You can prepare other arrangements with them for paying the debts.

You can lose some jobs for not having good credit and having a judgement or a wage garnishment because of bad debt could make you lose that job. HOWEVER, it must be stated in your contract, that you would have signed upon employment or on your employment application.
