matercard bill charged off. Sent to a collection agency. They are demanding 30% of the amount be paid now with the rest to follow in the next to months. Offered to make payment arrangements pay something every month that we can afford told no. Told would be sent to court.

Is there any way you can make direct arrangement with MasterCard? If you can call the credit company and they agree to your payment plan, you won't have to deal with the collection agency. Try it!

Collection agency cannot threaten you with court unless they confirm that your file is with them. Did you get something in writing? Check the fdcpa laws and know your legal rights. You'll know to how to deal with them. There may be many things they are doing against the laws and you are not aware of it. You can bring them to normal by knowing about your rights.
