I received a summons from a process server tonight from attorneys representing this company. While we have been negotiating debt settlements with our other creditors (and have settled half of them), this is the first time we have ever been contacted by Palisades - a summons, we've never gotten a letter or phone call from them.
Can a collection agency take us to court without attempting to contact us first?

Probably yes! the summons should look legal and you have 20 days before the court hearing takes place. The sheriff will serve you the papers. You have proof of your accounts taken care with your creditors. You can explain this to the judge. Show this to the CA also because their is no reason for them to take the matter to the court when you are already taking care of it. Chances are that your creditor has not informed the CA with the latest.[size=7][/size]
