payday loans are driving me insane

i took out a few payday loans and now i'm out of work on bedrest 9i'm six months pregnant).

this people call me everyday, try to withdrawl outrageous amounts out of my account to the point i'm overdrafted 800 dollars. today one of the companies hit my bank for 4 different amount which means the bank will charge me 35 for each.

this is very stressful bad enough i have to worry about not going into early labor, i had a lady from nationwide cash call me she was so rude and abnoxious she wanted me to commit to date when i will pay and i said i couldn't she was screaming and saying things to make feel like crap.

i need all the advice i can get, this is just the beggining and i feel is going to get worst, they called my job and said i owe money and i'm hiding form them, i'm afraid they will start calling my references and discloding the same information.

please, please, please help i really need all the advice.


First you need to open a new account at a new bank and let that overdrawn account close, redirect your direct deposit to your new account. How long have you been paying on these internet pdls? Chances are you have paid the principal and interest back already and you should demand they mark your account paid in full. Also file complaints with your AGs office.

You should also use the template letter ont his site to demans a settlement with them, and demand they mark your account paid in full if you have already paid the principal and balance. You can get through this and it will be over before you know it. We are here to help you and support you. Sounds like you have enough stress as it is.

I'm going to say by the dates these loans were taken and the amount of time you have had to roll them over, you have more than paid them back. Demand they mark your accounts paid in full. It may get ugly in the beginning, but in the end if you stand your ground you will come out ahead and they will fold.

Ambassador is Nationwide. Get your letters drafted and sent out. Get your complaints into your AGs office. These types of loans are illegal in your state so you are only obligated to payback the principal only. Tell them to go............can't say those words on this forum. They are going to make threats illegal ones at that. Don't be intimidated, hang up on them. Put in your letters you filed a formal complaint with the AGs office. If you get that complaint in the AG may be able to assist you with getting refunds, which is something you should be demanding in your settlement letter.

First of all you need to calm down and remember that your health is what is important right now and that of your child.

Second of all, contact your bank and request that place an stop payment or statement of unauthorized debit on your account which would prohibit these PDL's from taking money from your account. If that fails, close your account and open another one with another bank. You might want to try to open a savings account.

Next, contact a debt counselor. A lot of the posters here can recommend different ones that you can choose from. From there, you can speak with a counselor to lead you to the next step.

You may also want to contact the PDL's, explain your situation and tell them that will not be receiving any payments and ask what kind of arrangements can be made.

Just remember to take care of yourself.

drowningindebt - don't let the lady (whom I know who you are talking about) intimidate you. She has tried it with me and she will threaten you in all ways, just laugh at her. Do like Steelers1 says and do your complaints to your AG ASAP..and also call the AG of New Mexico and tell them too. The baby and your health are the most important right now. Also talk to your bank and let them know what is going on and see if they can put a block for you. My bank was real helpful in this situation, I had to pay them $36.00 fee but it was well worth it.

Drowningindebt, you live in MA, which prohibits pdls, you are only obligated to payback the principal in this instance. Looking at the dates these loans were taken out, you have more than paid back the principal. I would get your complaints in with your AGs office, and send out the settlement letters demanding they mark you paid in full. I can tell you that these companies go by so many different dbas they will hit your account under another name if you block them. So it may be in your best interest to open a new account. Many others here will tell you the same thing. At first I blocked them, then one hit me up under another name out of the blue, my bank recommended I open a new account which I ended up doing.

That is true, I have been lucky as far as that..My bank did some of their own investigation and I have not been hit again, I do know they have pressed Fraud Charges against one PDL..I was able to get my money back into my account. It was hard for me to open a new account because in FL they can still hit it and could activate it again up to 30 days on an old account, so the bank set up a RED FLAG on my account and I had to give a list of all my Direct Deposit and Automatic Withdrawal accounts to them, and if something goes through that is not on the list they will question it. I am fortunate about that, because I know alot of people aren't that lucky.

I know this company is part of Cash Supply, hit them up with letters. I'm going to search for the phone and fax number as well. I even have one of the top dogs personal cell phone number from NM, (surprisingly enough, it has a Atlanta area code), also have his e-mail address. I'm so sick of these people's ridiculous threats. They threw the fraud threat at me and then tried to deny it, then the supervisor listened to the recordings from the CR, I gave her the date and the time of the call which helped her track the recording and she heard it for herself. Acted like she tells her reps not to do that and she was shocked, whatever.

An internet payday loan cannot garnish your wages, unless they are licensed in your state. A store front lender may be able to, since they generally follow the law.

An internet lender can use a wage assignment, though..This is NOT A GARNISHMENT!!!! The company may call it a garnishment, but it absolutely is not. A garnishment is always court ordered, period. A wage assignment is voluntary, and if your payroll dept allows voluntary deductions you can revoke the assignment with a simple letter stating that you revoke your digital signature and do not authorize any wage assignments.

i'm from mn, but i contacted the attorney general's office; they then contacted the dept of commerce and the better business bureau and there's also a place under the fair debt protection act which i've used when they've given out info and called my employer threatening to take my hard drive from my computer.
one place got banned from the bbb - a place in florida was the loan co. they keep on/on, and my loans are over 3 years old and they like $1500 now for a $200 loan - ridiculous. the above companies did help though.

i've sent my letters and many emails to this companies.

i can harrass them too!!! i'm very good at that LOL.

the only people that call was GFS and i told them they could not debit my account again and i was willing to pay them the original amount of the loan.

the guy starting stuttering and he said they can only do ACH to get their money so i told to find a way and i also need it a letter from them saying they agree and my account was paid in full..he siad i'll call you back.

I think i did my job, i intimidated him LOL

yes good name but i will not claim victory yet, i got a call form cash link i've paid them 779.00 on a 200 loan and they still want more money, they guy left me a voicemail saying i HAD to get back to him by friday to avoid further consequences I should go andhid underneath my covers LOL

i will sleep on it until tomorrow because i emailed them my letter today so maybe i'll get a response or something.

so far route 66, ameriloan, nationwide and 500 fast cash have gotten my letter via email about 15 times today and no calls yet.

tomorrow is another day...i dream about this all night i thinkn is driving insane this mess i got myself into...

Route 66 probably won't respond. They will probably be the worst one to deal with. All the others, while breaking many laws, are at least semi legit. Route 66 is not even operating under "US" law, so they claim. But they also only use verbal contracts, so they have a very short leg to stand on should they try anything.

ameriloan hit my account this morning with $500 "check" this morning after told them not to go in because there was no money in there, and i've sent my letter to them like 50 times...i'm so furious

the last time i talk to them the rep said to call back in 2 weeks(that was this week).

my bank wont pay for it but i'm still overdrawn $600 so i cannot close the account...

i think i started my day with the wrong foot!

ameriloan has done the same with my account. i told them numerous of times not to hit my account because there were no funds in there and they still did. i even asked them to make arrangements with me and they said call back in 2 weeks. when i did call back they said they had no record of me calling and talking to anyone. They have my bank over drawn 1000 dollars just because of nsf charges from my bank

My husband and I just took out a loan with someone called GFS. Is that the same one you all are talking about here? They said that we were approved and that we should receive the money into our acct. within 3 days. Now I am scared because I was reading on the internet that it is a scam. What do you think that we should do? I was thinking of waiting a couple of days and then closing the account.

dont do business with them. they will rip you off and then harass you. i have been dealing with them for a couple of weeks and they are ruthless. i had to close out my account and now they call me at least 20-30 times a day(even at work) and threaten to put me in jail. funny i thought they got rid of debtors prison about 150 yrs ago!! then they said i would be arrested for check fraud but i never sent them a check or even signed anything. it was all done verbally over the phone. i have written several congress people about this matter and they are looking into it. i really think these companies should all be shut down...they are taking advantage of people who are in need of money and don't know the laws.

drowningindebt-everyone is right hear...you have read a lot of my posts and I know where you are at, I am battling 10 of them so mine is a little worse. But regardless of how many more I have the stress and frustration is the same, do yourself a favor, close out your account immediately!!! The only way to be safe is to close out the account and open a new one. Start on your letters tonight, email them, fax them, mail them...whatever it takes. I faxed copies to the AG and BBB. You can make the complaints online with the BBB, that will calm them down a bit and and stop calling you as much. If they call you at work tell them that your calls are recorded and you are now telling them to not call again and if you call back again my company (who already knows my situtation) has advised me to tell you that they will forward the recorded call to the local and state authorities. The letters worked for me, I haven't received one call at work. They blow up my home phone, they try to stay away from email because it is written documentation. Just know ahead of time that they are gonna say whatever it takes to get money from you, these companies are all Loan Sharks. That is why so many state AG's are going after them. The same company will give multiple loans to one person by using multiple DBA names because they have your account number and will ride on it every two weeks, these companies make a fortune off people. Their time is running out though. And the more people who fight them and turn them over to the BBB and AG's the more of these guys will fade away. You are in a state that really protects you and would LOVE to hear that these guys are still giving loans. Get that information of to them ASAP. You are not alone, everyone here has or is still dealing with these clowns. You have overpaid on all your loans so don't give them a dime more, turn it around and go after them for refunds!
