I rec'd a call at work today from a Carolyn no last name given. She told me if I did not call her back by 5:00pm they will garnish my wages. Is this true?

A garnishment cannot happen without a court order. A local sheriff will serve the summons 20 days before the court hearing. You are asked to appear at the court and file your case. It is the judge who decides garnishment after going through both the parties' cases.

This lady is breaking the federal laws by giving you legal threats. Did she send your account info in writing? You need to know the debt for which she is collecting. Report the company to your local attorney general. You should also check the licensing of this CA if they are doing fair business in your state, it sounds they don't

Is this a PDL? If it's an internet payday loan company, they probably aren't licensed to lend in your state, and will never be able to get a judgement anyway. They can use a wage assignment, however, which is a voluntary agreement that you digitally signed with your contract saying in event of default you agree to have your wages deducted. This can be revoked with a simple letter.

If this is not a pdl, Trenity is absolutely correct..You will get notice of a court hearing. If it does come to this, make sure you appear in court, otherwise they will rule default and you will be garnished.

At this point, try to make arrangements with them..You really don't want this going to court.

?? Please clarify your question.
The worse case scenario, if you ignore a judgement, switch jobs as soon as the garnishment order hits etc., etc. - i.e. actively running away from a court-ordered payment, then they may charge you with Contempt of Cou4rt, which does carry a jail sentence, fine, or both. That's about it.
