What do I do now?

I too had a free trial with Bally's for over a week back in 2000. I never had a membership. Then I saw on my credit report from Asset Acceptance that I owe Bally's over $3500 dollars for a membership that I never had. I asked the credit bureaus to repeatedly investigate this but they continue to keep it on record. Now in 2006 they have entered a judgement against me without me even knowing about a court date. I went to the court to have the judgement vacated and have a new trial. Now what do I do?


Many people get smacked with the "free trail" on many things. Since I actualy go to Bally's I know what happened to you or have an inkling. You took the tour, signed up for a free week or 30 day trail when they took you into the office. Unfortunatly this is where they stuck you. You had to have signed something, possibly but not limited to given them some credit/debt card info, to continue your membershop after the trial was over. It would have stated in there that you would have had to notify their coprerate office in writting within a certain amount of time to cancle the contract.

Here's where I might be able to offer some assistance. Since Bally's contracts are usualy two to three years long durring any of that tme did you move more than 30 miles away from that gym or any bally's gym? It will be possible to get a portion of that contract dismissed if so. But you are going to have to prove it.

There might also be the possibility that they lost the paperwork that you would have signed. Write them a letter and ask for a copy of it. If they don't have it they can't tie it to you.
