Too much info. Where do I start?

Hi,

I need to get out from under this pdl thing. Where do I start? There is so much information on this site that it's difficult to even get started.

Any help would be appreciated.


If the state law (from the website sent in a previous reply) shows $16.67 per $100 for a 14 day loan, and I've been paying $90 for a $300 loan, have I overpaid the loan? The site doesn't give me what I'm looking for in a language I can understand...

Tasha, I don't understand what you're saying. Not sure how to stop worrying about the online lenders when they are the ones tapping me dry every pay period. WHat do you mean?

She is right, the storefronts are the ones that follow the laws and can and will take you to court or garnish your wages to get thier money back. The internet ones most likely aren't licensed in your state, but you should check. They won't come after you like the storefronts will. Close your bank account and open a new one. Stopping payments may not work as most IPDL's will use several business names, hence if you block one name, they will just withdraw using another name.

I think what Tasha is saying is that in most cases, the internet payday loans are illegal. If so, you would have the upper hand pretty much in paying them. To get them to stop tapping into your money, though, you will either have to put stop payments on them, which could get expensive, or close your account and open a new one. If you do this, no matter what these companies tell you, don't give them your new account info.

As far as the store front PDLs, those more than likely ARE legal and have to be dealt with (payment arrangements) in order to stop them from further collections. These are the ones that can take you to court.

Also, to see if the payday lenders are legal in your state, do a google search for pollyandsay's blog. From there, go to the right side, green section, where it says Corporations by state, find your state and type in the names of the lenders. These you have to type in exactly as they appear. If it comes back with no info, they're not licensed, and that's to your advantage.

mbrevrick, Welcome to the forums. Payday lending is LEGAL in Iowa. You will have to take care of storefront lenders first. You have a tough list of internet lenders to deal with. I would contact Attorney General and see what they can do. The more complaints these states get the better. You will have to contact internet lenders also. You can close your account and make arrangements with them. Please file complaints maybe they can help. KYSIDE38

Hi,

Does anyone have a template for a snail mail letter and email that has worked? I'd like to get working on this today. All of my loans are coming due again next Friday, and I'm hoping I can get a few of them taken care of by then.

First thing you need to do is take back control of your bank account by closing it and opening a new one. Go into your branch, ask to speak to a manager, and let them know your account and routing number was compromised online and you need to open a new account. And than DO NOT give this account information to ANYONE no matter how much they threaten. Now the ball in your court. They will threaten you with everything including jailing your best friends invalid grandmother. They can do nothing! Go back over your bank account and find out how much you have already paid back. Than you send out Polly's template letter to settle with the pdls, just insert your state's pdl laws: http://pollyandsay.yesdebtfree.org/template-letter/aws.

If they do not mark your account Paid in Full Immediately, than start filing complaints with the Attorney Generals office, and make sure you CC: them on every complaint. Good Luck!
