Do I have a case?

I have a similar question - I received a summons for pretrail from Sprechman and associates as well back in June. I sent the demand for verification letter (specifically asking for a signed contract) within the 30 day limit not once but twice with no response - I then received a summons in August with a statement attached from the collection agency (which I had previously send a demand for verification letter to as well) - I went to the pretrail and was ordered mediation - I once again demanded the verification - which court has not been postponed another two months. If the attorneys cannot produce such documentation - do I have a case? I have no knowledge of this account.


The request for verification has nothing to do with the lawsuit. If you want to request verification within the lawsuit, you have to serve formal discovery requests on the DC. See your state's rules of civil procedure (probably rule 26 and subsequent), which you can probably find easily enough through Google.

Or, as I continually recommend, talk to a consumer lawyer.

Polly who is a moderator on this site has done alot of legal research on her own to deal with her pdl situation and gone to court representing herself in her legal matters. I believe that citizens have access to law libraries, I could be wrong. But you should be able to access resources to gain info. to assist yourself. Sometimes there are firms that offer pro-bono services.

I've said it before, but you don't know what a lawyer costs until you call one. I take debt collection defense for a fraction of the amount owed, or for a greater share of the fdcpa case that will follow the collection defense. In the second case, my client never pays me a thing.

Most consumer attorneys have a policy of never charging their clients, or of having their clients pay only for the costs of litigation (<$500).

You can certainly get help to assist yourself, as well, or you can try contacting your local legal aid office.
