if i close my bank acct. and they send my check what can they do to me. i plan on paying them back i just have other bills to pay right now i live in texas.


Are these internet or storefronts? If they have a papercheck and it is returned due to closed acct. they will contact you to make payment arrangements first. BUT in TX you can have charges pressed against you if the check is returned due to closed acct. or stop payment on the check. But they will contact you first to make payment arrangements, this is of course, if you are dealing with storefronts. Internet pdls aren't licensed and they do not have a papercheck from you that is another story all together.

what charges can they bring and will i go to jail, plus if they call me and want 1 lump sum.

Writing bad checks is what I believe the charge would be, and then in that case the prosecutors office would notify you and you would have one last opportunity to make arrangements, and if you don't do that within a specified amount of time given then they would issue a warrant. I sent you a pm.

what if after they run my checks thru r u sure they will call me to set up payments, and what if they want everything up front.

jackragan - if they are storefront PDL's, try to make payment arrangements with them. If you don't, they are within their legal rights to come after you and file suit for the bad check. That can carry some heavy consequences, no matter what state you're in.

Check your state's PDL laws - see what repayment plan is allowed for, if any, and go from there. But definitely don't ignore these loans or try to play hardball with them. Most storefronts follow state laws, because they are actually a physical, brick & mortar business located in the state where the loan is made - unlike the internet PDL's. You can't play hardball with the storefronts like you can the internet PDL's.

That's not to say the storefront PDL's won't be nasty to you or make threats - some of them still will. I personally am dealing with one right now that agreed to let me make payments every week, as long as my loan was paid off by the end of the year. I've made two payments on that agreement, with the understanding that I would make a large payment on 12/1/06. As of today, I was informed that the "corporate office" would be handling my account as of next week, and that I would start receiving nasty letters from them - 3 letters - 1st a notice of what I owe, 2nd a warning, and 3rd a final notice before legal action would be taken. I've been made to feel like criminal every time I go in there - I've been told I'm a liar, that I made the branch manager "look bad", that my account made her look like "an incompetent manager", etc etc. Big time guilt trip. I just maintained my silence, paid what I could for the week, and told her I'd be back next week and walked out.

This same branch manager threatened me with legal action before, then backpedaled and said if I came in every week with a payment, eveything would be fine, no legal action. Yet now, I'm threatened yet again.

Your best bet, jackragan, is to make arrangements with them right away. Explain your situation to them, and be sure you make arrangements you can afford - don't promise them an amount you aren't sure you can handle - you'll just be back in the same situation before you know it.

You should contact them and beat them to the punch. Let them know you are going through hard times and want to make payment arrangements, some may at first say they want it all up front, but if you insist that isn't possible they will eventually work with you. They will first try to deposit the check I'm sure of that. Most people here with storefronts contacted the company and made arrangements. But if you default due to insufficient funds they will initiate collections activity and if they are unsuccessful chances are they will file a civil case against you to get a judgement.
