I filed a chapter 128 debt consolidation with my attorney. Among the debts are 7 payday loans. I was told to stop payment on the loans or close my checking account. At this time, I was able to stop payment on 5 of the loans but don't have the fees to stop payment on 2 of them. On Monday, the attorney will file the necessary papers for the debt consolidation. My question is: Can the payday loans that I don't have a stop payment on take their money from my bank account even after the consolidation is filed? Can they call my job even after the consolidation is filed? Thank you for your help.


One your attorney files, the courts will send a notice to all creditors that you have filed a Stat 128. The notice acts as a restraining order on all collections activity. They will have to file a claim with the trustee, and will receive their payments through the trustee.

If they violate the courts order, and continue taking payments, you can file complaints and seek damages.
