CRA again reporting charged off debt past SOL

13 Year old charged off debt is now back on one of the CRA's; stating that I made a payment! I never made or have had anything to to with that debt since 1993. Collectors are hounding me now. What should I do?


You have to draft a dispute letter and highlight the item posted negatively in your credit report. Send the dispute through certified mail to the credit bureau that is reporting it.

If the CA says a payment was done on the account, ask them to prove it. Send a copy of your dispute letter to the CA and make them aware that they have inserted an item that is too old to be reported in the credit report now.

Give utmost legal importance to the letter mentioning the laws in the fdcpa. They are inserting incorrect negative item and this is an FDCPA violation. If they are unable to prove the payment done recently, the item must be removed from your file.

Thanks. I did do an on-line dispute about 3 weeks ago. I just got a response from what looks like another collection agency "Merchantile Adjustment Bureau" stating they "received notification of my dispute and they have responded to the inquiry and verified the information in our file". They are requesting I send them documentation. THIS IS NOT THE CREDITOR. I called the creditor (a credit union) prior to making the CA dispute asking them why they had reported a payment? They stated they charged it off in 1993 and they haven't reported anything since. They suggested I dispute it.

This Merchantile Adjustment Bureau, I shouldn't have anything to do with them? It states at the bottom that it is a communication from a Debt Collector. Is this some tye of trick to "trap" me?

Get the debt validated by Merchantile Adjustment Bureau. If they have your file, then the purpose of reporting in your credit report will sound legitimate. Otherwise, get them removed from your file. Use the communication with them as proof and show it to the credit bureau. In any case, the debt is too old to be reported in your credit file. Get the proof if they are saying a payment was done by you.
