I would call the courthouse and ask the clerk of courts if there is a judgment against you. I had a lawyer who was sending papers that looked very official with "Rocky River Municipal Court" across the top, making me think it was from the court itself. When I called the courthouse, though, they had no record. I was glad I called because this lawyer was asking for my banking info, paystubs, income tax returns, a copy of my car title, etc. The clerk of courts told me unless it came through the court, I didn't have to honor it. So I think that should be your first step is to call the courthouse and ask them. Good luck.

Perfect advice. You need to confirm if there is any legal case against you and you will know only after calling the county clerk.
If Asset Acceptance has a real judgment against you, it will be shown in your latest credit report also. Check your copy and find out what's happening. If they have inserted the judgment illegally in your credit report, your credit scores are getting affected. You have to run a dispute with the credit bureau reporting it and get the judgment removed after verifying with the county clerk.
A legal case at the court will take place at the consumer's state. You don't have to travel all the way to Minnesota

Actually, in Minnesota, the laws are a little different. A debt collector never needs to file the lawsuit with the court to start garnishing, etc.
You'll need to bring this to a lawyer. If you want to contact me privately, I'd be happy to take a look at the paperwork.

Ok, I posted the first question and then after reading the paperwork closer it apprears that they sent me just an affidavit stating that they could collect on this debt. In my first letter to them I requested proof of the debt and that they could collect on it and this is what they gave me... Is this really considered proof? And then I looked into the SOL in Colorado and had trouble finding a simple answer on how many years etc... This debt is over 14 years old now. It does not appear on my credit report and want to make sure that they don't get to list it on there.
