I received this email today and I have already over paid the principle amount to this account. This is their first response to me.

We are in receipt of your "cut and paste form letter" circulating on the Internet.
You came to our website, you were given the terms and conditions, there was an option to cancel without a fee within 48 hours. In addiiton before each debit you were given an account summary that explained all the options for repayment and the terms and conditions once more. If you had wanted to avoid additional fees, you needed to pay in full on your first due date or soon thereafter.

You signed a contract, if you want it faxed, we can do that with a number you provide. Otherwise unless you have a specific complaint regarding the handling of YOUR account, you will now continue in collections. You will need to call 1-800-636-9460 to make arrangements with the collections dept.

How should I respond?

msk, If you have overpaid then I would say no more. Keep complaining to AG and they will get to the bottom of this. These people are vultures. I think they would have us paying for the rest of our lives if we would. KYSIDE38

msk, I agree with kyside. They're just trying to see how much more they can squeeze out of you. I hope you told them you reported them to the AG's office and that they are currently investigating their illegal lending practices. I think that was the clincher for DMS Marketing for me. This is just a little bump in the road. Don't let it get you down. Let us know if you hear any more from them. Good luck.

Yep. Just send off your complaint to the Attorney General's office and be sure to copy them on it. Be sure and state that despite the fact that although you have repaid the principal and more than the legally allowed interest in your state that the company continues to attmept to extort additional funds from you with threats and intimidation. That one worked like a charm for me.

Ok here was my response:

Regardless of where I received the formatting for my letter that I sent you, the letter was still a legal document sent from me and received by you, which you have now acknowledged receiving. This letter, your responses, as well as mine are all being copied directly to the Texas Attorney General????????s office and Better Business Bureau. I have already informed them that even though I have already paid back the principal and more, I am still being threatened as well as extorted for additional funds. You will now be investigated and is only a matter of time before you are contacted. Again, I am not asking for a refund, just that my account is marked as ???????Paid in full???????. Thank you.

msk7777 - way to go on your response to that nasty e-mail! I hope they realize they are not dealing with an uninformed consumer, but one who knows their rights and where to take their complaint.

Thank God for yesdebtfree.com - this community is helping so many with something we had no help with in the past!

Well its a battle for sure, these people are nuts, USFastcash still wants more money. I got their response to the BBB complaint I posted. The original loan amount was $300 and I have paid a total of $500 in finance fees, they still want me to pay $325. After the complaint I made thru BBB they said that I sent them hate mail and made no valid complaint to them. My response to the BBB was I never sent hate emails and have a copy of every email sent and will gladly provide them with a copy of it, and that my "complaint" was that they are giving loans to people in Texas without a license and the interest rates they are charging are higher than what our state allows. Also that I have already paid my loan back as well as $200 in addition. They said they would settle the account for $125 and I responded that they would then receive more than 100% of the principle and that is loan sharking and that I wouldn't pay a dime more. So in short, I turned down their offer.
