Hello again everyone:

I have prepared my letter for the pdl companies. I need to fax, email and send this letter to the PDL companies today. Would you kindly review and comment on this initial letter.

I am writing to you today, November 17, 2006 in regards to my (dollar amount) internet payday loan received from (company). Do to uncontrollable circumstances, I have closed my bank account and have no intentions of opening a new one. It came to my attention on Friday, November 17th that your company is in violation of Oklahoma laws:

Citation: Okla. Stat. Ann. tit. 59 § 3101 et seq.

Loan Terms:

Maximum Finance Rate and Fees: $15 per $100: $0- $300; $10 per $100: $301-$500
Finance Charge for 14-day $100 loan: $15

Criminal Action: Prohibited

The (company) contract that I signed is only governed by the law of the state in which your company resides is uncorroborated. There is a specific Federal case law that contests this statement. (PDL company name) solicited, accepted and transacted business with a citizen of the State of Oklahoma, thus you are subject to the laws of this state, which are noted above and available via the internet.

(PDL company) has exceeded these laws by debiting my account ($ insert dollar amount) per pay period. According to the laws noted above, you are not abiding by the laws set forth by the state of Oklahoma.

I have paid you a total of ($XXX.XX on a ($XXX.X) loan. Thus, I will forward two payments to (PDL Company) for ($insert dollar amount) on January 5th and January 20th, 2007. At the time my final payment is made to my account on January 20, 2007 – my account with (PDL Company) will need to be noted as ‘paid in full’. At no time will (PDL company), any representative of (PDL company), parent company, subsidiary, or affiliate of (PDL company), place any derogatory mark on my credit report with any credit bureau, nor any other check writing database, such as Teletrack or an equivalent database. If (PDL company) does not abide to the settlement conditions stated above, I will have no choice but to file a civil suit against (PDL company) stating that (PDL Company) has been illegally conducting business with a citizen of Oklahoma. I will also formally complain to, and request that the Attorney General of Oklahoma, (your state’s Attorney General’s name), file criminal charges against (PDL company) for its illegal lending practices to a consumers within the State of Oklahoma. All correspondence as of today November 17, 2006, shall be in written form either through the email address, XXXXX(at)XXXX.net, which I provided to you at the time of the application, or by writing to (your contact information) via the United States Postal Service.

Additionally, I have advised my place of business regarding my personal finance issues and they, (your employer), has advised me to inform (PDL Company) that all phone calls are recorded and under no circumstances am I to receive personal phone calls at my place of business. Therefore, my employer has advised me that if I receive harassing and/or continuous calls from (PDL company) they will turn the matter over to the local and state authorities. In addition, I have notified my references of your potential phone calls and provided them with the Oklahoma Attorney Generals mailing and website address. Should (PDL Company) contact my references they will immediately submit a claim to the Oklahoma Attorney General. Additionally, I have provided them with the Fair Debt Collection Practices Act (fdcpa) mailing and website address. If you should contact them, they will be forced to file a complaint with the FDCPA against (PDL Company).

Please acknowledge receipt of this letter, and acknowledge acceptance of and willingness to adhere to the settlement described above, in writing via email and/or USPS.

Thank you for your willingness to work with me and adhere to my firm requirements as noted above.
