I need help quick, I received a response from Tremont Financial via email stating the following:

Dear ,

We’ve been trying to contact you to make arrangements to pay off the balance on your outstanding loan. We have even attempted to debit your account to make good on your outstanding balance, but we were notified by The Bank that your payment did not clear.

Our legal department now is reviewing this matter. Please review the Note & Disclosure Agreement you signed under the section entitled “Consent to Assign Wages upon Default.” Unless payment arrangements are immediately made, we will be drafting a letter to your employer , to make arrangements to have your paycheck debited for repayment of the outstanding balance on your account.

To avoid us taking this action, please call me at 1-888-357-9106 to make arrangements for payment. We will waive any additional late or collection fees if you contact us and make payment arrangements immediately. You can also payment via MoneyGram’s Express Payment. Simply visit any MoneyGram location and send $492.00 to Tremont Financial using our receiver code of 4003. Please see the attached form for further details.

Even if payment arrangements need to be made, let’s work together to get this taken care of now before it could cost you even more!

I closed my account on Friday due to the overwhelming amount of money coming out of my account due to internet PDLs. I owe them and I due plan on paying (divided into two payments) on the 5th and 20th of January. How do I respond? I suppose it is beginning and I have nine total, this is just contact from one. Thank you for your help.

I am totally panicing and I thought that I would be calm about the decision to go to battle. My adrenaline is pumping and this is just the first one to contact me. I still have eight more with the following, gfsil, arrowhead, cashnet500, cashusa, Little Loan Shoppe, one step cash, magnum finance, and national money store. Any information on these folks? I've never dealt with Tremont, but relax, once you revoke the assignement they cannot attach your wages without a court order. Have you done a search to see if anyone else here has dealt with Tremont? I can tell you that cashnet500 will be a problem, they are still a headache for me.

Do a search for wage assignment and you will find some good form letters. Just put your info in and send them out today.

Most of your PDL's will probably fight to some extent, but just be calm, as long as the law is on your side you can make it through this.

What state are you in again?

I would also attach a copy of the other letter you wrote to them with the payment arrangements. If anything, I'd also call them on the phone and read it to them. There is a feature on this site that lets you record your phone calls. Just make sure you are following the laws about notifing people in your state and the state you are calling or else you could get in trouble for that.

Most of these companies respond only to repeated attempts. I would be emailing your last letter to them as many times a day as you can. Certified mail is expensive, but maybe mail normal mail a few times a week too. These people need to know you are serious, and sometimes it can take quite a bit of work on your part.

Additionally, I am well informed on the laws of internet loans. Your agreement does not apply to residents of Oklahoma ???????? only the state in which Tremont resides. I am more than willing to work pay this loan on January 5, 2007. Additionally, my employer is well aware of my financial situation and they have informed me that I can not accept personal calls at work. Please contact me, as you did in this email or via USPS ???????? so that both your and my agreements are in writing.

Thanks, unfortunately, due to the family issue unplugging my phone is not an option - if they need me they are to call me - I do have caller id and a recorder. They are welcome to leave numerous messages or call and hang up for all I care. I sent the following email to my office staff:

I have closed my bank account due to fraudulent activity from internet payday loan companies. These people are scum and unfortunately, I did not do my research on these internet companies prior to accepting a loan with these companies. If I had, I would have known, from the many postings online, that they have been reported to the Better Business Bureau, several State Attorney General????????s offices, and several other legal/government entities. According to the postings online, these companies will do what ever they can to harass and threaten me into paying them more money. Also, according to other individuals online these companies may contact my co-workers, friends, family, etc. and start degrading me, talk poorly of me etc. I wanted to forewarn you, and request, that if you should answer the phone and have to deal with these individuals please simply inform them that I am not allowed to take personal calls at work ???????? if they are reluctant and stating empty threats, please patch them to me immediately and I will, again, tell them that I am not allowed to take personal calls. Thank you so much, I am hoping that this matter does not reach this extent ???????? however, I believe it is important that I inform you in advance should this happen.

rmalcolm, I am sorry to hear your problems. Take care of your family first. Once you have the peace of mind, call the company. You need to send the revocation letter to the company because they have sent a mail that they will be contacting your employer. Legally speaking, you have to send the wage revocation letter to the company after they have notified the intentions. If your employer tells that they tried to debit from your paycheck, send a copy of the revocation letter to him also so that he is informed and everything is documented. You have to take care of this now because their is no proof with the company that you have revoked their rights. A sample letter is drafted in this link. Send it through certified mail and return receipt requested for ensuring the delivery. After this, you are covered.
