Hey BrownSugar,
Are they offshore?? The reason I'm asking is b/c Cash Today called me on Thanksgiving Day last year--and we all know they're in London.
And by the way,
A very happy Turkey Day to you!!!!!
This is a credit card company and they are located in Delaware.

They can.
There are no federal or state laws mentioning that collection calls cannot be done on holidays.
Credit card companies will call because they want you to pay the debts. Try to work out suitable arrangements. They will be willing to work with your plans.

Man,
Not only do they call on Thanksgiving--but you can bet they don't pay their people time and a half for working the holiday!!!!!! I almost feel sorry for them...
Yea, they should let their staff off to enjoy the holiday.

I'm not at all surprised that they make their staff work on a holiday - they probably don't give them benefits either.
You are so right, SB--and they probably pay them minimum wage!!!

Yup - and with most of them being in other countries, they can get away with paying slave wages and not be held responsible for it.

And you would think that since today is one of the biggest holidays in America, they would think that their chances of getting alot of calls made would be slim and next to none! Almost as bad as calling people on Christmas.......

I cut the woman off real quick. I told her "of all days of the week to call me, why today, since it is a holiday?" She said, "well, your payment is late." I told her "you could have called me yesterday or some other day, but not today!" Then I hung up on her.

Here's a thought. Don't answer your phone on days you don't want to be bothered by creditors or collection agencies.
They can and will call any day of the week, including holidays. Most companies give this day off because they don't want to pay the holiday pay.
They can and will call you at Christmas. Trust me. I should know

Brownsugar, They call when they want to. Drive Financial called my brother when his baby was in intensive care at the hospital. They actually called the intensive care unit at the hospital. So these companies do not suprise me at all. They violate Fair Debt Act all the time. KYSIDE38

They probably figure that is a day you're off work, you would probably be home cooking some nice food, spending time with the family.
What a nice time to call, when you're in the middle of saying grace. You're less likely to argue with them because you don't want to "embarass" yourself in front of company.
Well, I'm sure that's true - most folks would be less willing to
Well, I'm sure that's true - most folks would be less willing to argue with them, but I for one would be more willing to hang up on them. LOL
I'm calling the phone company tomorrow to block numbers that come up as "unknown name/number", meaning they've got caller ID blocked. It will cost me a little extra every month, but it's worth it not to have to screen those calls. If it comes up "unknown name/number" right now, I just ignore it, and 9 times out of 10, they don't even leave a message - so I can only assume it's an autodialer from a telemarketing company.

Kyside,
They called the ICN????????? What did they think your brother would say, "Oh, let me walk away from my sick baby, as my late payment is more pressing???????" Some people just need to get a clue!!!!!!
Kyside, If this isn't against the fdcpa, I don't know what is!
Kyside,
If this isn't against the fdcpa, I don't know what is! Also under the FDCPA, isn't there a part that says they can only call you at your contact numbers? And how is the ICN a contact number, right?
The only way I could think of them getting that number would be
The only way I could think of them getting that number would be someone giving it to them. I would seriously be kicking one of my relatives/neighbors butt's for doing it too. Great way to add more stress to an already stressful situation.
Why would your brothers place of employment be giving out person
Why would your brothers place of employment be giving out personal information to complete strangers? Don't they know that's illegal? At least it is in some states. I know I would be mad if someone from my work place was blabbing information to anyone who called for me.
If the agency knew in advance that someone was in the ICU and called anyway it is hugely insensitive. But if they called and were transfered before knowing about the situation then that makes they were doing their job. All hospital visits aren't all emegent.
I've even been cursed out because I didn't notify my debtor of a situation while he was in the hospital for a short visit. His family never gave him any messages.
I siggest you have your brother take the person they called down
I siggest you have your brother take the person they called down to a police station or at the very least get the person, with their permission, on a recording stating what the agency said when they called.
