Laverne, did you register here for the free counseling? A consultant will discuss about your issues and arrange payments with your pdl companies. What type of loans you have and how much have you paid on the accounts? Every state has the laws on payday loans. You are required to pay what your state allows. The lenders will keep withdrawing unless you stop them and become aware about your rights.

Hi laverne welcome to the boards many will be glad to assist you here. what state are you in? Who do you have payday loans out with? Are they Internet or store front? You need to close your bank account and get the ACH withdrawl stopped and the only way to do this is to close your acct. You need to pay your daily bills first, you have to have electricity and water first. Good luck and keep posting

Laverne, Payday lening is legal in Illinois. I would try to make arrangements with storefront. According to your state laws you can enter in to a repayment plan. Someone will be contacting you from this site a debt counselor that hopefully can work out something. Also please complain to the Attorney General in your state. These complaints are starting to get action. Best Wishes KYSIDE38 :D

You may have to go to another bank to open up a new account, or just put a block on these companies from debiting your account, there is a fee per block.
Here is the link to your state's pdl laws:
http://www.paydayloaninfo.org/state_detail.cfm?id=IL
If you have paid back the principal and legal interest rate for your state you can demand they mark your account paid in full. Or demand they settle your account for what you actually owe. And you can use the settlement letter found on Polly's blog, just insert your state's pdl laws and add that you have filed a complaint with your AG's office because you will need to do this (for the internet pdls, storefronts are typically licensed, and I noticed you have CashNetUsa (internet pdl)I have found with this particular ipdl they are also licensed to loan in the state's they offer loans to consumers. You will need to work out a payment arrangement with the storefront and CashNet if you find they are licensed in your state. And don't worry, you won't go to jail, even if they threaten and sound realistic with the threat. Your state does not allow prosecution for defaulting on a pdl, and you haven't committed any type of fraud, which is what some will claim.

laverne. You are going to be ok. None of the internet pdls are licensed to lend other than if they are lucky in their own state. How long have you been paying on them? You should open a new account, this is the only way to gain control back of your finances. Polly has a template settlement letter on her blog, use that and insert your state's pdl laws, and also insert the fact that you have filed a complaint with your AGs office. You are going to get through this.

I know how she feels Steeler. Those things are so intimidating if you don't know the law and know your rights. I mean they had me in knots trying to figure out how to pay them back and still live. I am just recently getting my life together. But we can all help you. This is the right place to get the best advice. I came here and I have never looked back.

Alexdra is right. We have all been where you are at right now, desparate and depressed. But once we learned our rights, took control back over our accounts, we started feeling a huge relief and were able to start sleeping at night. I can tell you that I LITERALLY fell asleep each night with my calculator and not knowing what I was going to do. You WILL get throught this and if you follow the advice others are giving you and take it to heart, and take action, you will be feeling ALOT better withing a few days! :D

Lavene, you are going to be fine
1. You have the link to your state laws
2. Go to polly's blog and use her settlement template letter.
3. OPEN A NEW BANK ACCOUNT (very important to gain control over your finances back)
4. File a complaint with your AGs office, these are unlicensed pdls loaning to a consumer in your state.
5. Start these steps, and don't back down with your demands in the letters to mark you paid in full, sometimes it will take e-mailing them mulitple times a day, but if that is what it takes then do it. Most here have had to do that.

Laverne, you should also aware of the payments done on each pdl account. Keep the state laws at one side and check your payments in the bank statements. You have to make sure how much money is paid on them and move from there.

I just stumbled across this site and I am looking for some help. Where do I find the information on PA laws for internet Payday loans. Also, where can i find the blog that has the template letters. I am planning to contact my bank on Monday to submit the revocation forms to stop the 5 loans that I have coming out of my account. Is it better to open a new account?

If these are internet pdls, they are unlicensed to lend in majority of the states, what state are you in? I highly doubt an unlicensed company conducting business in a state in which they are not licensed will step foot in a court room to sue you, why do you think they are always threatening people with arrest and so on, to scare more money out of them.

Laverne, read through this thread you started, in the beginning the steps are there for you to start dealing with these internet pdls. Take it one step at a time and you will knock these guys out. They are not going to have you arrested or take you to court if they are internet pdls, they are unlicensed.

The pdls won't do anything to you. Most of us here, myself included have had to close out our accounts to get control back from the pdls to pay our bills. They will of course threaten you with arrest, charges of fraud, but IGNORE them these are illegal threats and you will NOT be arrested or charged with anytype of crime.

If you have already paid back the principal and legal interest rate your state allows in the roll-overs and they are still rolling over your loans. You can use the pdl settlement letter on Polly's blog to demand they mark your account paid in full. People do have success with this, myself included. I have had all of my pdls marked paid in full because I paid back the principal and legal interest rate in my state in all of the illegal roll over fees. I also filed a complaint with my AG's office which was a huge help. I will post the link to Polly's template letter, you will need to insert your state's pdl laws and let them know you filed a formal complaint in the letter. I will post the link to the letter.

Here is the link to Polly's letter:
http://pollyandsay.yesdebtfree.org/template-letter/

Earlier in this thread I posted the link to your state's pdl laws, which is what you will need to insert into the letter. Now you will get responses from these companies that you signed a contract stating you would abide by their laws. That's BS, and just be persistent and do NOT back down and repeatedly e-mail your settlement letters to them.

I don't really care too much about Teletrak, you will just be in there and no other payday company will loan you money. Now Chexsystems is the one you don't want to be in, but these guys report to Teletrak. I don't know of these guys reporting to credit reports, you could dispute that anyways because they are unlicensed in your state, I've not heard of anyone here having it reported to their credit report.

so the intetnet pdl are not licensed you said, all of my pdls are from the internet even though we sign papers they have us fax sheets, can this hurt us i guess since so many people like myself have did this they really are finding a way to make sure they get there money.not explain to what is teletrak and what is chexsystem how can i check for the checx system. what goes to chexsystem. will the payday loans try to go to the chex system and how do you clear the teletrak?

Here is the link to each state's pdl laws, just click on your state:
http://www.paydayloaninfo.org/states.cfm

Payday loans do not use chexsystems, that is used by actual banks and other reputable LICENSED businesses. You can always dispute what is on Teletrak just like a credit report. Since these are not licensed storefronts, but rather internet payday loans you have a better chance of getting things settled, and if you have already paid back the principal and legal interest rate for your state, then you should be demanding they mark you paid in full.

Steelers - I looked at the laws for PA, however I am not sure what they mean.

I have pasted this below.
Citation:
Check cashers are specifically prohibited from making payday loans under Check Cashing Licensing Act of 1998, ???? 505(a). Otherwise, consumer discount company act applies. 7 Pa. Cons. Stat. Ann. ???? 6201 et seq.

Small Loan Rate Cap
$9.50 per $100 per year discount or 24% per year

I want to understand what my next steps should be and how I should go about closing the account etc (see my previous post)
