How Fair is Midland Funding/Aspire Visa?

I just got a letter in the mail from Finanical Counselors of America telling me I am being sued by Midland Funding, I called them and they gave me a dicket number, this is the first I have heard about it...I am on disability, my outgoing is more than my incoming and am barely able to scrap by each month,I have nothing for anybody to get..Aspire Visa gave me a credit limit of 300 over 4 years ago,at that time i was working but an injury cause me to become disabled and it took 4 yrs to get my disability...but Aspire kept adding on all sort of fees to bump the amout up to over a 1,000...even though they discharged the card..how can they get away with doing this, what can I do?


Did you check the court where this case is filed? The county clerk will check if this case is filed by the company in a proper way.

When did you last pay on the debt account? You may check for the SOL in your state and confirm whether the CA has a legal case or not. You can't be sued after the expiry of the SOL. It's calculated from the last payment date and considering the statutes mentioned in your state.

Aside, you should talk to Aspire and work out payments if they have filed the case at the court.
