I have a loan with these jokers also. I am in the process of paying them off. They say that I owe them $125.00 for a $100.00 loan, remember I live in NC and am only required to pay back the principal. Ok, I paid them a $25.00 renewal fee, $31.25 money order, and now they say that I owe them $93.75 more, b/c there interest is below my state laws (prohibited, 36%). If I am correct I only owe $43.75, right?????

Hi, I, (my name) currently have a PDL with your company. I live in NC and PDL are PROHIBITED here. My principal amount was for $100.00, and on that I have paid ($25.00 renewal fee), and a money order payment ($31.25), for a total of $56.25. According to my AG's office, where I have already filed a complaint, I am only required to pay back $43.75 more, for a total principal of $100.00. I am requesting that the settlement offer be considered or my account marked PAID IN FULL. Please acknowledge receipt of this email, and acknowledge acceptance of, and willingness to adhere to the settlement described above, by email, within 24 hours of receipt. If I do not receive this acknowledgement within 24 hours, I will begin further legal proceedings. Thank you,

Try this:
Your Name
Address
City,State
Phone Number
Acct#/social security whichever they have on you

Brad Weathers
DMS Mktg/Loan Shoppe/PD6 Ventures
his contact info.

DON'T EVEN BOTHER WITH NICITIES. I would drop the Hi. And proceed with your acct. inco and purpose of your letter. You could even use Polly's settlement letter and e-mail that to him. That is what I would do.

so you took out a loan, knowing they were not allowed in your state and now you are trying to skirt the payback? so if smoking were found to be illegal would you try to have the tobacco company pay you back for all of the packs of cigs you bought?

pay your bills and move on.

Guest, why would these companies issues these types of loans in a state where they are prohibited. There are legitimate internet pdls out there who actually obtain licenses to loan in the states they offer services and they follow the individual state's pdl laws. Those are the companies I trust and would do business with. And why is it when the officials get involved these unlicensed internet pdls suddenly want to settle the accounts to get the AG off their back? If they were in the right, why would they not fight the officials?

They are TRULY illegal in some states, and most people do not know this. And I would never tell somebody not to payback money they borrowed. And you are obligated to pay them back along with the LEGAL interest rate, learn your lessons and know that you are not allowed to take such loans in states where they are prohibited.

Guest, when people take out these loans, they ASSUME they are legal, and then LATER find out they are illegal.

You'll never hear out of my mouth to not pay back what would be legal in your state. I don't believe anyone should get out of paying anything that they rightfully owe-according to the laws of the state that they reside in.

guest, do you think 1770.00 in fees for a 200 loan and still owe 400 is legal?? you must be smoking something and you ovbiously have nothing to do with your life other than read the post and annoy everyone, if you think we are so wrong it hurts you just leave that's all.

i think we should just ignore the guest he will eventually get the point!!!!

Guest, I don't think anybody is arguing that they would pay back the principal and legal fees, and in the case that the legal fees aren't paid back, then that all depends, is that internet pdl licensed in that consumer's state? If they are then they have the option just like any other creditor to seek a legal civil judgement in that case. And it isn't up to us to decide what happens to "those people" that is for the legislature to decide and I think those laws are already in place.

i personally would not fight the legal fees, however these amount is too much and with this verbal agreements the fail to explain the rates and that is really impossible to pay them off...when i wanted to pay off my loan they wanted 350, then 400 then 500 each week they add $100 or 50 to my account this is stealing!

You should really put in that complaint with your AGs office, they do respond and pay attention to consumer complaints. I was skeptical at first myself, but I knew I would never know if I didn't complete the process. And they responded the very next day with me and with contacting the ipdls.

Sharon Williams told me this:

Quote:

"You need to provide the proper documentation if you're disputing this debt or there is nothing the Attorney General can do if we have our proper documentation to support our company. ALL information needs to be faxed to 1-866-323-6555. Thanks."

This is my response to her:

Quote:
"That is incorrect, they are illegal in the state of NC, and the AG's office incourages the people of our state to file complaints against PDLs. I will forward the information from my bank asap. All other companies are abiding by the rules and have marked my accounts paid in full.

On March 1, 2006, the North Carolina Department of Justice announced the state had negotiated agreements with all the payday lenders operating in the state. The state contended that the practice of funding payday loans through banks chartered in other states illegally circumvents North Carolina law. Under the terms of the agreements, the lenders will stop making new loans, will collect only principal on existing loans and will pay $700,000 to non-profit organizations for relief.

I live int NC, definitely contact the AG office 919-716-6000(I think that is the #) speak with someone in the Consumer Protection Office. Typically they will provide you with information on completing the complaint form and what you need to go with your claim. I filed complaint and I am waiting to speak to someone from there office. Unfortunately we have been playing phone tag, but they are very interested in online payday lenders
