I had an old visa that I stopped paying on (my daughter had a stay at a mental hospital and I needed all monies for testing etc). I stopped paying in 2003. I never heard anything from anyone until the doorbell rang at 9:30 p.m. and they served my 12 yr old daughter with a summons for me to go to court. First of all this is unethical and probably illegal. A court date was set. I decided to call the attorney's office and make a settlement. They were extremely rude (of course why would they be nice). Before any settlement arrangements could be met I had to give them financial information (where I bank) and employment information (self employed). They told met that they would settle for $3,455 and I somehow got them to agree to a one time payment in the amount of $3,000 as PAYMENT IN FULL. They told me they would send me a letter stating it was paid in full and cancel the upcoming court appearnce. Further, they said for me to contact Midland Credit to have them remove it from my credit report. Yesterday I received a letter from their office (attorney's office) stating the $3,000 was partial payment. They are trying to default on the settlement agreement we made. I paid the $3,000 immediately. What recourse do I have? I'm afraid it's a "he said she said" situation here. If someone could give me some advice I would surely appreciate it.

Is there any way to prove the settlement agreement took place? Do you have the deal in writing or a telephonic recording? That should be an important proof of your sending the money and they are not showing your account as paid in full?

your next step is simple, guest--you got a letter saying "settled", thats all you need. Take a copy of that letter to them and tell them to go pound sand. Once they put it in writing that it is a settlement, there isnt anything they can do as long as you abide by the terms of that settlement. You should file a complaint immediately with the FTC as well as the attorney general's office in your state.....they are breaking laws and trying to rip you off.

The same thing just happened to me! I paid a settlement of a one time payment over the phone with these people and I was promised a letter of the settlement. I received a letter in the mail today thanking me for my "partial payment".... I am really freaking out here! I thought I was done with this firm, they clearly stated over the phone(multiple times) that this was a settlement and I would be completely done with them after this payment. Any ideas or suggestions?!
