I am being sued for a credit card loan by Midland funding llc I don't owe this the amount in question. I have a court date in Dec and Have received the discovery papers which I will reply to any syggestion on how to continue from this point?


Because tomorrow is Dec 1st, a verification of debt letter is too late to send, so you need to show up for that court date. Also what does the discovery papers say? Does it offer you anymore insite into this debt?

Also I did a search @ the rip off website and Midland has a few complaints against them for just this very case scenario. Send me a PM if you don't know what the rip off web page is..good luck BTW when is your court date?

I have received interrogatories papers to have back by the 7th of Dec. Planitiff is requesting me to admit to a balance of 6K but I only owe 500.00 but I can't prove this. In my first correspondance they stated they did not have any proof of me owing this debt. Should I dein all even having the card untill they gather proof ? can I ask the court for another court date for them to show discovery??? HELP

I don't know if you can plead now for another court date. But when you are at the court, you must ask for the proof of the debt from the plaintiff. You should only pay the amount that is in paper. Don't let the creditor get a case against you with any fictitious amount. The judge will be fair to the situation and you will be able to turn the case to your side.
