who can start garnishing your wages and if your wages are being garnished does there have to be a court order. I have a court date for a summons on december 8th and I wanted to know what happens after the civil case is over. do they start garnishing your wages right away or can you set up a payment arrangement with the creditor

The creditor can withdraw the case if you are able to work out payment arrangements outside the court. If they don't agree, the judge will decide how much you can afford in a month before issuing a judgment.

The court date is usually the last change you have to make arrangements..They don't REALLY want to garnish, they'd much prefer a payment plan, since a garnishment adds additional expense and paperwork. Make sure you show up in court, otherwise you WILL be garnished.
