CA called a co-worker and implied futher action against me
Date: Tue, 12/05/2006 - 11:53
First off, my co-worker just received a call from an investigator from A. S. & Associates Recovery Experts, Inc. in Texas. She told my co-worker that if I didn't call her back within 24 hours, further action would be taken and she had very important information to give to me. Can she tell a co-worker this information?
Secondly, I called her back and she is representing a payday loan company *SURPRISE* that I am not going to pay one more dime too. Anyway, she called me a thief and that I had to pay them more money. I told her no and she said I was a thief again. I informed her that in the state of Georgia, payday lending is illegal and EVEN if I didn't pay off the principal of the loan, the loan is illegal, considered void and not collectable whether paid in full or not. This is according to the AG and the state law. She again called me a thief and told me that I must have known that before I got the loan, which I have paid 500x more that I took out the loan. I told her that I did not and I have filed a complaint against US Advance with the AG office and the AG has sent a letter to the company she is presenting. She wants all the documentation that I sent to the AG and the letter the AG sent to US Advance. I don't mind faxing the letter from the AG, but I do not believe that I need to provide her with any information that I sent to US Advance or the AG. Any advice would be greatly appreciated.
Thanks!!

Phone calls of debt collectors can be secretly recorded in the state of Georgia. Do it and Sue the collector under section 806 of the FDCPA. This is a win win case.
Quote:
A debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section: (1) The use or threat of use of violence or other criminal means to harm the physical person, reputation, or property of any person. (2) The use of obscene or profane language or language the natural consequence of which is to abuse the hearer or reader. (3) The publication of a list of consumers who allegedly refuse to pay debts, except to a consumer reporting agency or to persons meeting the requirements of section 603(f) or 604(3)1 of this Act. (4) The advertisement for sale of any debt to coerce payment of the debt. (5) Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number. (6) Except as provided in section 804, the placement of telephone calls without meaningful disclosure of the caller's identity. |

Thanks for the advice. I contacted the AG and was told that they would like to send a letter to the collection agency too. They are theoretically aiding & abetting the making of an illegal payday loan, which is also illegal under the state's anti-payday statute.
Georgia has a great AG's office!
