Cashnet500 - Under investigation in Oregon!

I just recieved a call back from the Oregon Banking department, they license payday lenders. The guy I've been talking to called cashnet500 yesterday and told me he talked to tim Atkins. He said tim atkins refused to tell him who the registered agent was for their company, and gave him some long excuse on why they didn't need a license in Oregon. The banking guy said he was very unsatisfied with the conversation, and he's turned it over to their investigation department!

One thing Tim Atkins said during thier conversation was that they do use wage assignments. I was told by the banking guy that they are illegal in Oregon. The banking guy also told me that Tim Atkins asked him what it would take to settle this account, but since he wasn't talking to me or responding to the 30 emails I've sent him, and the banking guy can't answer that question for me, he didn't get an answer.

So my questions:

1. Does anyone know the registered agent for cashnet500/Global Payday/USACash Express?

2. Should I call them tomorrow and see if now they will mark my loan PIF or just wait and see what happens with the investigation? Regardless of what cashnet500 does I will cooperate fully with the investgators.

3. I've sent emails and a certified letter to cashnet500, but they refused the letter and never respond to my emails. In these I revoked the voluntary wage assignment. I've also done this over the phone in recorded conversations. Do I need to do anything else regarding the wage assignment? The guy at the banking authority told me they are illegal and unenforcble in Oregon.

goudah, The famous Tim. Anyways Wv is suing these goons also. They are in the 14 on the last list. They are also known as global. Also the business name I have is Leads Global Inc. Hope this helps Kyside38

If they are under investigation, then there is a good outcome that you will receive some type of refund with this company. I would let the investigators handle it, but if Tim wants to know how to settle it, use it as your oportunity to get your account marked paid in full and demand that refund, the ball is in your court now.

I actually owe them $35 on the principle, so i don't think I can ask for a refund, but being marked PIF and having them leave me alone would be great!

Aside from the volume of calls I recieve from rt 66, these guys are the worst I'm dealing with. They've threatened everything in the world. Yesterday they told me that since I wrote my supervisors name on the application, where it asks for it, that they were going to call her and tell her she would also be sued since her name is on my loan documents! Maybe on the planet they live on that's possible, but not here . . . . .

oh route 66 they have my blood boiling!!!!they call me everyday at home at work, and they dont stop.

Goudah, i will say let the investigators handle it, sorry you may not get a refund but hopefully a lot other people that have been ripped off will get their money back, god knows we can all use dome extra cash...

i keep dreaming that the same will happen with route 66 and mayb i will get a refund on the 1770.00 i paid for 200 loan.
by the way since GFSIL and route 66 are the same and i overpaid route and owe on the principal from GFSIl do you think i should tell gfsilto take from what route overcharged me?? i wonder how they will take this. LOL

So I called them this morning to see if they would settle, but was told that just yesterday my loan was sold to United Legal. That means that right after talking to the Supervising Examiner from the Oregon Payday Licensing Dept they decided to sell my debt to a collector? Does that make any sense? Has anyone else had this happen to them?

I also asked the examiner if they could take me to court over this. Here was his response:

Yes, they can take you to court. However, your defense would be the
company is not licensed to make loans in Oregon,
and Oregon law (ORS 82.025 (b) No person shall make a loan of $50,000
or less, except a loan made under paragraph (a) of thiss subsection, at
an annual rate of interest exceeding 12% per annum or five percent in
excess of the discount rate on 90-day commercial paper .... (4) Any
person who violates subsection (3) of this section shall forfeit the
right to collect or receive any interest or consideration than is
permitted by subsection (3) has been charged.

Your interest rate was 995%, far in excess of 12% per annum.

I also register collection agencies to collect from Oregonians. I
checked my database and I do not show a United Legal
registered to collect in Oregon. Should United contact you, get them
to send you something in writing. It would be
evidence that United is trying to collect in Oregon without a
registration. I will go after them for not having a registration.
If you are contacted by phone or email, ask them to send you evidence
of the debt. You are entitled to evidence of the
debt.

So now I don't know what to expect from cashnet500 . . . . Has anyone else had this happen? What can I expect from United Legal?

I just got off the phone with Tim. He claims that Utah law allows them to lend to other states! Since when does one state say what a business can do in another state? He refused to mark my loan PIF, even though they are under investigation and he knows it! He claims that since there is no federal law, they can do whatever they want. When I told him that about the case law regarding electronic businesses, he just came back with "Sears doesn't need a license for every store they have, why should we?" RIDICULOUS!!! I tried to explain that retail stores are not regulated like payday lenders and he wouldn't listen. We just went in circles for about 10 minutes until he finally said there was no way they were marking my loan PIF and I'd just better pay up! What a jerk! He won't listen to reason, and even with an investigtion going won't do the right thing!
