I have a loan on a truck with an exboyfriend. He has the truck and has not paid the truck in 5 months. I have no idea where he is and the bank won't stop calling me. What can they do to me if we can't find the TrucK?


Since you signed the debt jointly with your ex-boyfriend, the bank will hold you accountable when not receiving their payments. For this, they can put summons in your name and insist the judge to do garnish your wages. Banks wants to have their money back and since your name was in the papers, you will have to take care and arrange something.

The reason there is a co-applicant is because if the primary applicant doesn't pay, they go after the co-applicant. I wonder if you can locate the truck via teh DMV and perhaps the local police. The local police should be able to find him quick. I don't know fi they can arrest you, but I think after awhile they can sue.

No you will not go to jail, but they will sue you to recover the money or the vehicle. In fact they will come after both of you, the applicant and the co-applicant. Have you tried to contact the ex-boyfriend? I don't think they believe when you say you don't know where he is or where the truck is. I am sure you are being honest, unfortunately the bank does not care about hearing the excuses. Have you contacted them.

Guest first of all nothing has to be donw EIGHT now or today, you don't have to get it done today. Just keep in mind that as co-applicant you will be responsible along with him for the payments on the current loan or if they do find the car and repo it whatever tha balance is after they acution it off. Unfortunatly that id the down side of cosigning on loans as such. Keep posting and register we all will help you through this mess

I had a truck repo about 10 years ago. Yes the are most likely looking for the truck to take it back. If it goes more than 2 or 3 months, they go looking. It's already on your credit report as late and if it does get repo'd, then that makes it worse. I would keep in constant contact with the bank explaining the situation. Maybe they will have pity and be nice when it comes to reporting. When I've fallen behind on my current car payments, I call them and they have always been more than willing to help if I keep in contact with them. Now way back when my car was repo'd, they auctioned it off. If they got more than what was owed, that was good. The balance was paid off and in some states you get the rest I believe. Of course that doesn't usually happen which was my case. Then the bank came after me for the balance after the money they made on the auction was applied towards the balance. It went on my credit report as a collection until I eventually paid it. A collection agency or the bank can collect. No you can't go to jail over any of this. It's a civil matter. Hope that helps.
