Help with Nine Internet Payday Loans

I am writing to you today, November 17, 2006 in regards to my $300 internet payday loan received from XXX. Do to uncontrollable circumstances, I have closed my bank account and have no intentions of opening a new one. It came to my attention on Friday, November 17th that your company is in violation of Oklahoma laws: Citation: Okla. Stat. Ann. tit. 59 ? 3101 et seq.

The XXX contract that I signed is only governed by the law of the state in which your company resides is uncorroborated. There is a specific Federal case law that contests this statement. XXX solicited, accepted and transacted business with a citizen of the State of Oklahoma, thus you are subject to the laws of this state, which are noted above and available via the internet.
XXX has exceeded these laws by debiting my account $150 per pay period. According to the laws noted above, you are not abiding by the laws set forth by the state of Oklahoma.
The total amount to be paid to XXX, according to Oklahoma laws is $300 plus a $45 finance charge. I have paid you a total of $150.00 on 11/06/06 for a $300 loan. Thus, I will forward four payments to XXX for $48.75 on January 5th, January 20th, February 5th and February 20th, 2007 totaling $195 which is the remaining balance on my account with XXX. These payments will commence once your acceptance to this offer has been sent and received via email and/or USPS. At the time my final payment is made to my account on February 20, 2007 ? my account with XXX will need to be noted as ?paid in full?. At no time will XXX, any representative of xxx, parent company, subsidiary, or affiliate of XXX, place any derogatory mark on my credit report with any credit bureau, nor any other check writing database, such as Teletrack or an equivalent database. If XXX does not abide to the settlement conditions stated above, I will have no choice but to file a civil suit against xxx stating that XXX has been illegally conducting business with a citizen of Oklahoma. I will also formally complain to, and request that the Attorney General of Oklahoma, Drew Edmondson, file criminal charges against xxx for its illegal lending practices to the consumers within the State of Oklahoma. All correspondence as of today November 17, 2006, shall be in written form either through the email address, goneriding(at)oklatel.net, which I provided to you at the time of the application, or by writing to XX, Oklahoma via the United States Postal Service. Additionally, I have advised my place of business regarding my personal finance issues and they, XXXX, has advised me to inform XXX that all phone calls are recorded and under no circumstances am I to receive personal phone calls at my place of business. Therefore, my employer has advised me that if I receive harassing and/or continuous calls from XXX they will turn the matter over to the local and state authorities. In addition, I have notified my references of your potential phone calls and provided them with the Oklahoma Attorney Generals mailing and website address. Should XXX contact my references they will immediately submit a claim to the Oklahoma Attorney General. Additionally, I have provided them with the Fair Debt Collection Practices Act (fdcpa) mailing and website address. If you should contact them, they will be forced to file a complaint with the FDCPA against XXX.
Please acknowledge receipt of this letter, and acknowledge acceptance of and willingness to adhere to the settlement described above, in writing via email and/or USPS.

Perfect letter! Send it through certified mail and return receipt requested. You are obligated to pay the interests and fees according to your state. All loan companies have to follow the laws where the borrower resides.

Sorry to hear about the loss of your brother in law. Good luck with your payday loans and remember don't let any of them try to intimidate you or threaten you with illegal garbage. It appears your on top of things now and hopefully this will all be over for you real soon. Keep us posted on the outcomes as you start to hear things.

Well, you are to be commended for taking the matter under control by sending letters (and a very well-written one) to these PDLs. Hopefully, some refunds or at least PIFs will be coming your way. Hi rmalcolm, I am sorry to hear about your loss. Right now you need to deal with that and helping your family. You did the right thing by closing your account so now they can't bleed you dry. Send that letter registered mail and concnetrate on your daily life. These loans will be cleared up in time and while they want their money yesterday, its not going to happen.
