Another Stop Payment Problem

I had a similar problem in the past. A storefront deposited my paper check and it was returned unpaid, so I put a stop payment on the paper check on my following payday b/c I figured they would try to redeposit. Well, they did deposit it again, but this time it was an electronic check. I asked my bank about this and they had told me an electronic check is similar to an ACH debit and if I needed to put a stop payment on an item in the future, I should let them know if it is going to be a paper check or an electronic check. My bank also told me that it takes a few days longer to process a stop payment on an electronic check. That's the problem I've came across in the past b/c you never know how they will deposit it. I have a friend that works at a storefront and she had told me that the first time they deposit, it is the paper check, but if it is returned unpaid, they will try to deposit it again electronically on your payday. Another storefront that I've ran across, will ask if you want the actual check deposited or ACH debited.

So--I guess I'm stuck then. I am so mad, so frustrated and depressed. Jackas*es. Oh wait, I guess I'm the jackas-s for taking out the stupid things to begin with.

This seems so ridiculous to me. If you can take a paper check and turn it into an electronic draft "just because you feel like it," then what is the point in even having stop payments???
What happened to the Uniform Commercial Code and the whole definition of a negotiable instrument? Signature doesn't matter anymore... just because I know your account # I can go take money out of your account.
I think it would be so funny to get these PDLs bank account #s and just start taking money out of their account; see how they like it?
stop payment
Amen to that one debtcruncher!!!! Dont know how they get away with the stuff they do. What gets me is they accuse us of fraud. KYSIDE38

I was thinking that I either read something somewhere or heard about it; that you have to give consent before a paper instrument could be turned into an electronic draft. Is this true?

I would like to go find an old-fashioned bank somewhere, that doesn't have any electronic capabilities. No ATMs, No ACHs, No Online Bill Pay, No Direct Deposit. If you want to take money out, you have to sign a paper check; if you want to put money in, you need to fill out a deposit slip and hand it to the teller.
I would feel a lot safer about my money...
I wonder what would happen if you called the police department,
I wonder what would happen if you called the police department, and reported theft ... that these places took money out of your account without permission.

Lorri. Do you still have a copy of the contract from the storefront pdl? It should state in the contract that if you paper check is returned, then they will convert it into a electronic check. When we had store front lenders in NC, that was one of the things they had to go over when you got a loan.

Lorri since it is for under $500 I would call the SFPDL and try and wok out something with them, start giving them good faith money anything you can afford, give the cash and get a receipt

Well see what I did was send the names of all to my debt consolidation company and then put stop payments on the checks. Then they went ahead and cashed them. I guess I have to find out if they accepted proposals from the debt consolidation company.
Yeah check with that company, they should have that information

Lorri--
I know a girl that works at a storefront in my area and she had told me that for their company, putting a stop payment on a check automatically stops everything. This being a paper instrument or an electronic draft.
I guess this one particular storefront honors that, but I'm quit
I guess this one particular storefront honors that, but I'm quite sure that others feel that even though a stop payment is put on a paper instrument, they can turn around and redeposit it electronically :(

The way banks work now with electronic debits I would be very careful with trying to "figure" out how money comes out of your acct
