- applicable Federal and state statutes, common law, and case law;
- the fact CTC is not licensed to lend in my state;
- the fact that wage assignments without a handwritten and in-person signature are illegal in Texas.
- how unethical it was of her to call my references and tell them of the "urgent need for her to get a hold of me" when I had left her a message literally 15 minutes earlier with my contact number
- my demand that she not call me at my place of employment because I cannot accept non-business calls.
- and my statement that I will not pay anything to CTC until I see a debt validation letter, or at the very least, something in writing itemizing the amount I owe and why I owe it, ie, something tantamount to a debt validation letter since CTC apparently does not have such letters.
OH MAN. Her way of handling this call after my comments was priceless.
A) She accused me of fraud for knowingly signing a wage revocation agreement in a state that would not honor it;
B) She accused me of setting out to default on the loan from the start because I knew they were not licensed in Texas.
C) She stated that she will continue to call my references. (Oddly she said that she will honor my request not to call my employer).
D) She stated that she is sending my account to Universal Something or Other in Texas for third-party collection and that they will "PURSUE LEGAL ACTION AGAINST ME."
E) She stated that people like me are "one in a million" and that the other 999,000 people she deals with treat her civilly." She then accused me of bullying her when I responded that "the other 999,999 -- yes Ms. Burton, if I'm one in a million the others are 999,999 not 999,900 like you just said -- must not now that there are federal and state laws that protect them from unfair debt collection tactics.
F) She told me they do not accept mail and will not send a debt validation letter.
G) She told me not to call her back just to harass her.

I really can't get over Lisa Burton's response to me today. It's sad that this bullying approach probably works on the overwhelming majority of Lisa's "clients." In dealing with PDLs, Lisa and Nick from FTR have been by far the biggest bullies of all.

Anyone know if there is a specific third-party collection agent CTC, et. al. sends its accounts to? She claimed that since I'm in Texas they send it to a Texas company whose name starts with Universal.

CTC has been in default only for about 4 weeks. All my other PDL
CTC has been in default only for about 4 weeks. All my other PDL defaults were prior to rehab and most have been taken care of. As stupid as it sounds, I actually used the CTC loan to pay-off two other loans.
I was able to get the loan because I had a bank account and 30-day statement that did not show all the other PDLs or NSFs from another account. And since I am receiving a pretty decent direct deposit check into that account, they approved me for $700, which was enough to pay-off two PDLs.
CTC and FTR will be the last people I pay-off because they are such blatant violators of the fdcpa. On the other hand, the guy who keeps calling me from Astro Lending just sounds clueless and incompetent. He's just like monotone "pay this off or we're sending it to a third party for legal action." Like he's just reading some script and could give two-thirds of a shit about his job or getting my money.

I thought of another great thing she said. She told me she couldn't get a hold of me yesterday because my phone was disconnected, "I guess you didn't pay that bill either." Actually, I turn my cell off during the day because I can't use it at work. So it just goes straight to voicemail. Idiot can't even tell the difference.

My loan is with Paydayavenue and they are part of CTC, Sonic, E-Care and whoever else. It has been in default since 10/20, and if they did send it to a third party collector, I haven't received anything yet. Lisa has only called me 2 or 3 times, and that last call was about a month ago.

If a letter was sent to my employer, I'm not aware of it. My HR and Payroll dept hasn't said anything to me. Any legit employer should not respond to a letter like this. For all the employer knows, it could be a scam; a case of identity theft, etc.

I have dealt with CTC in the past. You can send a letter revoking the wage assigment to CTC. The asssignment is voluntary. You can search the forum for a sample letter. Depending on the state you are in, the employer might garnish wages to pay for this debt. So make sure to send your HR a copy. I know in NC wage garnishments have to be by court order.
Also they sent the loan to the collection agency of Univeral Fidelity in Texas, which is not licensed to do business in the state.
