Can CashNet garnish my wages?

I originally had a payday loan from Global Payday and I have received a cal from a collections called Paramount. I was told that Cashnet has bought out Global Payday and that they have submitted my file for payroll garnishment. She also said that they told her on several attempts to talk to me that I have just refused to pay the loan. They have never tried to contact me and I have not spoken to anyone from here. Is it legal for them to garnish my wages? The reason I did not pay is because I have gone through so much in my personal life that money is not available to me and I did not intentionally get the loan and expect to not pay it back. They also said the only way to pay them is this has to be post dated on a check and I told them due to financial difficulties I no longer have a checking or savings account. Their advice to me ask a friend or family member to use their account. That is not safe and I would never ask for such confidential info from anyone, plus I do not hav ethe funds. What can I do?


They must have a court order to garnish wages. They may have had you sign a wage assignment clause in your contract. You can revoke that, it is totally voluntary. Send them a letter stating that you revoke any and all wage assignments you may have signed. They told me I signed one, but no where in my paperwork was anything like a wage assignment. Luckily, they are totally illegal in my state, so it wouldn't go through anyway. What state are you in? Do you have the original paperwork you signed? I'm beginning to think these guys fraudulantly make wage assignment documents, without the consumer knowing.

I am in Texas. I don't have the originalypaperwork because this was all done online and I did not think to print anything, but I don't remember anything in my documents about wage garnishments. I really think they are just trying to scare me, but they could be serious. The person who called me was actually from a collection agency.
